Subject: Grant of two (2) Easements to Florida Power & Light located at 6421 NE 2nd Avenue, Miami,
Florida and 6301-05 NE 2nd Avenue, Miami, Florida, (also know as Little Haiti Park).
Purpose of Item:
Rescinding Resolution No. 07-0028 adopted January 11, 2007; further authorizing the City Manager
to execute a grant of easement to Florida Power & Light Company of: (1) perpetual, non-exclusive
easement on a five (5) foot wide by approximately two hundred fifty-three (253) foot long strip of
City -owned property located at 6421 NE 2" Avenue, Miami, Florida and (2) a perpetual, non-
exclusive easement on a five (5) foot wide by approximately four hundred fifty-one (451) foot long
strip of City -owned property located at 6301-05 NE 2nd Avenue, Miami, Florida, (also know as Little
Haiti Park).

SUPPLEMENTAL SHEET
Subject: Granting two (2) Easements to Florida Power & Light located at 6421 NE 2nd Avenue, Miami,
Florida and 6301-05 NE 2nd Avenue, Miami, Florida, (also know as Little Haiti Park).
Background Information:
Pursuant to Resolution No. 07-0028, adopted January 11, 2007, the City Commission approved a grant
of easement of two (2), five (5) foot wide strips of City -owned property located at 6421 NE 2nd Avenue,
Miami, Florida and 6301-05 NE 2nd Avenue, Miami, Florida, (also known as Little Haiti Park), to
Florida Power & Light Company. Florida Power & Light has subsequently requested that we utilize
their form for said easements. The form as required by FPL does not provide any hold harmless
language, require insurance for damages and does not contain any reversionary language.
These easements will be used to construct, operate and maintain overhead and underground electric
utility facilities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be
installed from time to time; with the right to reconstruct, improve, change the voltage, and remove such
facilities or any of them within the easement, with full right of ingress thereto and egress therefrom.
These easements are necessary in order to bring electrical service to the new building and its facilities
being constructed in Little Haiti Park.
