HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01556 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER A PUBLIC HEARING, PURSUANT TO SECTION 2-614 OF THE CITY CODE, WAIVING THE CONFLICT OF INTEREST PROVISIONS CONTAINED IN SECTION 2-612 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO ALLOW CITY OFFICERS, OFFICIALS AND EMPLOYEES TO PURCHASE MEMORABILIA AND/OR ASSETS FROM THE ORANGE BOWL STADIUM. WHEREAS, on December 13, 2007, the City Commission approved an agreement with Dream Products, Inc., d/b/a Mounted Memories ("Mounted Memories"), for asset disposition services in conjunction with the Orange Bowl Stadium Demolition Project; and WHEREAS, the Orange Bowl Stadium has been in existence for 70 years and many City officers, officials and employees as members of the community have fond memories of the Orange Bowl Stadium and would like to purchase memorabilia from the Orange Bowl Stadium; and WHEREAS, Section 2-612 of the Code of the City of Miami, Florida, as amended, prohibits a City employee from entering into any contract or transacting any business with the City or any person or agency acting for the City; and WHEREAS, Section 2-614 of the City Code allows the City Commission to waive such prohibitions if such transaction is in the best interest of the City; and WHEREAS, waiving the conflict of interest will allow City officers, officials and employees to purchase Orange Bowl Stadium memorabilia and/or assets, thereby generating revenue to the City pursuant to its agreement with Mounted Memories; NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The prohibitions contained in Section 2-612 and 2-614 of the City Code, are waived by a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a public hearing, as such prohibition pertain to allowing City officers, officials and employees to purchase memorabilia and/or assets from the Orange Bowl Stadium. Section 3. The waiver set forth in Section 2 hereof, is based upon said transactions being in the best interest of the City. Section 4.
