Subject: City Commission authorizing the City Manager to negotiate and execute a Professional
Services Agreement for Expert Testing Consultant Services
Purpose of Item:
It is respectfully requested that the Miami City Commission accept the recommendation of the City
Manager approving the findings of the Evaivatiorcommittee pursuant to Request for Proposals No.
36012, and to authorize the City Manager to negotiate and execute a professional services agreement
with the sole proposer, Sharf & Associates, Employment Risk Advisors, Inc., to provide expert testing
consultation services in order to continue to comply with the terms of the May'1999 Federal Court
Order governing the Miami Police Depaitiuent, for an initial term of two years, with options to renew
for three (3) additional one (1) year periods, at an annual cost not to exceed $100,000

Consulting Services for Police Department Expert Testing Consultant, RFP No. 36012.
Background Information:
In order to ensure that the ongoing public safety needs of its citizens are met, the City of Miami
has utilized the expertise of an Expert Testing Consultant to guide the efforts of the Department
of Employee Relations' staff charged with administering these efforts.
Said services have encompassed activities in the areas of test development, score analysis, job
analysis, and selection procedure review on behalf of the Department of Employee Relations in
an effort to meet requirements needed to dissolve the 1977 Consent Decree. On May 4, 1999,
the Federal Court issued an Order that dissolved the Consent Decree with respect to all operating
departments of the City with the exception of the Miami Police Department. The Federal Order
grants the Department of Justice (DOJ) rights to oversee activities with respect to the Police
Officer and Police Lieutenant classifications, having been released from DOJ oversight for the
Public Service Aide, Police Sergeant and Police Captain classifications. The Expert Testing
Consultant will be working with City staff to prepare the necessary analyses and documentation
required for the dissolution of the Order with regard to the aforementioned classifications.
On August 24, 2007, the City issued RFP No. 36012 seeking Proposals to secure professional
expert testing consultation services for the Police Department. The Evaluation Committee,
appointed by the City Manager, evaluated the proposals received in response to the City's RFP,
and determined that the firm Sharf & Associates was qualified to provide said services and that it
was in the best interest of the City to recommend that Sharf & Associates provide expert testing
consultation services to the City.
Based on the findings and recommendations of the Evaluation Committee, and approval by the
City Manager, it is recommended that the City Commission accept the findings of the Committee
and authorize the City Manager to execute an Agreement, in substantially the attached form, with
Sharf & Associates, pursuant to RFP No. 36012, to provide expert testing consultation services
for the Police Department, for an initial term of two years, at a cost not to exceed $100,000.00
per fiscal year, with an option to renew for three (3) additional one-year periods at a cost not to
exceed $100,000.00 for each additional fiscal year; allocating funds from the Department of
Employee Relations General Operating Budget, Account No. 00001.171000.531000.0000.0000,
for the current Fiscal Year 2007-08, with future Fiscal Year funding, subject to only budgetary
approval. This contract will allow the City of Miami to continue to ensure compliance with the
DOJ May 1999 Federal Order.
