6. I have been involved in pro bono and community work since I was in high school.
I tutored grade school children in the North Philadelphia ghetto, worked on Habitat -like projects
in those same neighborhoods, and worked in similar projects at La Salle University.
While in law school at the University of Miami, I worked in Florida Rural Legal
Services. Since becoming a lawyer, I have devoted substantial pro bono hours to representing
indigents in courts, as a guardian ad litem, as a physical guardian, and as a tutor, volunteer, and
board member of different charities. I devote in excess of 1000 hours per year to this type of
activity.
I currently serve as Chair of the Bay Point Schools Board of Trustees and devote pro
bono legal and volunteer time to that institution. I serve as a mentor to many of its graduates and
work hard to support the school and its programs. I also serve on the Friends Of Drug Court
Board Of Directors and work with many substance abuse clients.

7. I believe that the reputation and integrity of our police force is one of the most
important features of local government. If the population as a whole does not believe that police
officers and their procedures are of top rate quality, it can tear away at the fabric and structure of
our society. By serving on this Board, I can assist the police officers of this city in their
commitment to the highest ideals of professionalism and service and can also help translate to
the average citizen an appreciation for both sides of a dispute or experience between citizen and
police officer. The Police Department is to be credited with being willing to participate in this
type of activity, and public -minded citizens must be willing to devote the time necessary as lay
volunteers to make the system work.
One of my mentors was my late partner and esteemed community leader, John Edward
Smith, who taught all of us at his law firm the privilege of pro bono volunteer work. John always
said that doing good was good business. He was correct, and I try to remain committed to those
ideals.

JOSEPH P. KLOCK, Jr. is a Member of the Firm in the Litigation practice in the Miami
office. Mr. Klock represents individuals and family groups who control large publicly and
privately held business enterprises with family control, entrepreneurship, and family
investment issues. In addition to handling corporate sales, combinations and mergers,
both domestic and international, he litigates civil, criminal, appellate and administrative
cases in federal, state courts, and foreign courts.
Mr. Klock works on financial, trust, and family wealth and interpersonal planning
matters, as well as interfamily disputes and enterprise structuring. His practice also
includes representation of foundations and other NGOs, formal and informal matters
involving government and regulatory issues, the defense of professional licenses, and
election law and constitutional/civil rights issues.
Mr. Klock's diverse and extensive experience includes:
o Representing then -Florida Secretary of State Katherine Harris in the 2000
presidential election challenges, personally arguing cases in federal and state
trial courts; handling appeals in Florida appellate courts and the US Court of
Appeals for the Eleventh Circuit; and successfully arguing two cases within
eight days before the United States Supreme Court, where Secretary Harris
ultimately prevailed
o Leading the teams that defended Florida election laws during 2001-2003 in
state and federal courts
o Heading a team of 27 lawyers in the representation of a major health insurer in
a $2 billion -plus False Claims Act litigation regarding alleged Medicare
overpayments, resulting in a favorable settlement for the client
o Serving as general counsel and chief legal officer of a major sugar producer's
holding company, with extensive operations in the U.S., as well as in the
Caribbean and Northern Europe, including hotel and resort operations in the
Caribbean
• Leading a team of lawyers in successfully resisting a series of suits seeking
damages in excess of $100 million over a 16-year period involving foreign
governments, federal and state regulators, thousands of workers, and
unrelenting local, national and international press coverage, resulting in three
jury verdicts in favor of the companies, all of which have been affirmed on
appeal
e Serving as a director to an AMEX -traded, vertically integrated producer of
beverage products
o Serving as a director of a corporation that operates resort properties in the
Dominican Republic, including Casa de Campo, and negotiating numerous
hotel management contracts for resort owners and developers in the United
States, the Caribbean, South America and Europe
o Litigating issues relating to water quality and the impact of farming operations
on the Everglades and surrounding waters and lands before the Florida
Environmental Regulation Commission and its Division of Administrative
Hearings, as well as in state circuit courts and district courts of appeal and

e Handling politically sensitive and high -profile cases with extensive media
coverage, as well as federal, state and environmental group interests, including
successfully arguing against amendments to the Florida state constitution that

would have singled out farming operations for penurious taxes
• Serving as co -personal representative of one of the largest estates ($500
million -plus) ever probated in Florida, overseeing multiple investments,
including extensive oil and gas interests in Texas
• Advising clients on wealth management and family wealth dispositions as well
as complex U.S. and international marital litigation including the restructuring of
business and property interests across the globe
• Negotiating the breakups and dissolution of business entities, resolving
complicated business disputes and being frequently selected to mediate and
negotiate intercompany and interfamily disputes without resort to the courts
• Handling MDL and complex class action defense cases in federal and state
courts
• Handling post -trial and appellate issues involving novel or monetarily significant
issues, most recently the defense of a $79 million verdict in federal court in
South Florida
• Frequently arguing cases in the Florida Supreme Court on novel issues of
Florida constitutional and public interest law
• Representing numerous private and governmental institutions in South America
and the Caribbean
Mr. Klock is deeply committed to pro bono practice, and has successfully handled more
than 80 cases in state and federal courts for indigent clients involving criminal and
dependency law, landlord/tenant rights and discrimination issues, as well as
administrative actions in Florida courts for individuals and nonprofit institutions. He also
is extensively involved in dealing with the issues of drug abuse and the response of the
judicial system to the challenge of cure and recidivism on the adult and juvenile level. In
addition, Mr. Klock has served and is currently serving as guardian ad litem for a
number of orphans and children in state dependency custody.
Mr. Klock serves on the board of trustees of Barry University, Belen Jesuit Preparatory
School and the Miami Art Museum, and has served on the boards of trustees of
Carrolton School of the Sacred Heart (chair 1987-91; 1994-98) and St. Joseph's
Preparatory School in Philadelphia. He is the secretary and a board member of New
Hope Charities, Inc., which sponsors schools and various support and medical
programs for the indigent in the western part of West Palm Beach County, Florida, as
well as Fundacion Mir in La Romana, Dominican Republic, which runs trade schools,
AIDS clinics and an orphanage for the underprivileged in La Romana. Mr. Klock serves
as board chairman at the Bay Point Schools, a boarding school for young men with
behavioral and delinquency problems, where he also teaches on an informal basis. He
also serves as a board member of a nonprofit corporation that supports the work of the
Miami -Dade Drug Court and on an advisory board to the County's Juvenile Justice
Center.
Mr. Klock has been honored with the University of Miami Center for Ethics and Public
Service Lawyers in Leadership Award and served as president of the University of
Miami Law Alumni Association, where he was later honored with the Outstanding
Alumnus of the Year Award. Mr. Klock also served as an adjunct professor of law at the
University of Miami teaching civil procedure, federal jurisdiction and real property for 10
years following his graduation from the school.
Mr. Klock also has been recognized with a doctor of humane letters from La Salle
University. He has served as a panelist at The American Lawyer's Law Firm
Management Seminars, has written articles on civil procedure and has served on the
Federal Judicial Nominating Committee in the Southern District of Florida, a group
charged with nominating individuals for the United States District Court (district judges
and magistrates) as well as candidates for the post of United States Attorney and
United States Marshal.
Mr. Klock has been named in Who's Who in America.

opportunity to work on Capitol Hill with the Congressionai Black Caucus and in the
"Foggy Bottom" area of Washington, D,C, at the United State's Dept. of State. This up -
close and personal experience with the concept of public service through governmental
action excited my general interest therein to an even ga-eater degree than before. During
law School at Georgetown University in Washington, D.C.. I had the opportunity to
further this interest while working at the U.S. Dept. ofJustice. This experience presaged
my entry into the practice °flaw as a "career prosecutor" from my role as an ADA at the
Bronx District Attorney's Office through my position as a homicide prosecuting Division
Chief as on Assistant state Attorney at the Miami State Attorney's Office.
During my career as a prosecutor 1 had the opportunity to work closely with law
enforcement agents such as the New York Police Department (NYPD) and New Jersey
State Police as well as all the local law enforcement agencies servicing Miami -Dade
County including the Miami -Dade Police Department and city of Miami Police
Departrneat.
My responsibilities often required me to work closely with the various agencies,
particularly MPD and MDPD in reportin.g as the on -call prosecutor to homicide crime
scene investigations with a critical and objective eye as the homicide scene was secured
and the on -call Pathologist from the Miami -Dade Medical Examiner'[s office examined.
and photographed the body of the deceased. Some of -the many media -related homicides
I have investigated or successfully prosecuted include the homicide of University of
Miami football player Bryan Pata; the "Church of Satan Killer" and the "Vegan Baby
Homicide case". These matters were extensively covered by media organs such as Court
TV, ESPN, CNN, Fox News and others.

homicide crime scene investigations and autopsies. I have had occasion to lend my
experience to these investigations, sometimes in a helpful suggestive capacity, and at
other times in a critical, corrective capacity. But, at all times with. an objective fairness in
the interest to the accomplishment of the justice in the common good.
I believe that the aforementioned experiences uniquely qualify me for the rigors
of membership the City of Miami Civilian Investigative Panel.
Finally, I am confident that I. possess the experience, skill, determination and
objectivity to serve this August body with great distinction and hope to be able to further
discuss my qualifications with you in person.

University of Michigan Union within walking distance of my childhood home in Ann
Arbor calling fr the formation of the "Peace Corps" was, later, greatly instrumental in
inspiring me along lines of public service:
My college years ex-ternships at the U.S. State Department and on Capitol Hill
gave way to law school employment at the U.S. Justice Department and ultimately
resulted in my becoming a "career Irosecutor" .in three states. In addition, to my prior
experience closely working with la\v enforcement including the City of Miami Police
Department, I have recently started my own law firm, whtich specializes in. civil and
criminal defense and litigation.
I believe my perspective from both ends of the legal spectrum uniquely qualifies

program wherein I, in conjunction with local with state and local law enforcement, chaired strategy
sessions designed to target and irradicate from geographic zones, the
county's most dangerous violent offenders. lncludeded Grand Jury practice and jury trial after Indictment.
Taught implementation of this program to prosecutors and police personnel
throughout the State of New Jersey on behalf of the Attomey General's Office.
Career Criminal Unit, March 1992-August 1996. Indicted and prosecuted
by way of jury trial the counties most dangerous repeat offenders.

Herb was raised in the small mid -western college town of Ann Arbor,
Michigan. While in college, Herb participated in a number of the university's extra
curricular activities including a stint in. Washington, D.C. on a foreign policy
internship at the United States Department of State and a Congressional Capitol Hill
internship; residence hall government; fraternal public service activities; sang in
the Gospel Choir and even successfully completed a two-year stint as a running
back on the varsity football team after "walking on" during his freshman year.
After graduating from college with honors and a Bachelor's Degree in Political
Science, Herb departed Ann Arbor for the Georgetown University Law Center in
Washington, D.C., where he pursued his Law Degree on a Georgetown University
Fellowship, as one of only eight(8) scholars selected for this prestigious award
University -wide. While in Law School at Georgetown University, Herb led one of
Georgetown Law's Moot Court teams to a regional championship qualifying the
Georgetown Law team for the national moot court championship. In the process,
Herb was named the "Best Overall Individual Oral Advocate" and also received the
award for co-authoring the "Best Written Brief. Additionally, while attending
Georgetown Law School, after an extremely demanding school -wide competition,
Herb was selected as one of the founding members of the nationally -cited
Georgetown Journal of Legal Ethics, later becoming an administrative editor of this
prestigious legal journal. He also served as a founding member and the first vice-
president of the Geogetown University Law Center chapter of the Christian Legal
Society. Herb also traveled to the Middle -East to study Public International Law
abroad in the land of Israel at the Tel -Aviv University School of Law.
After graduating from the Georgetown University Law Center, Herb begin a
career in public service as an Assistant State Attorney with the Bronx District
Attorney's Office in New York City. Herb also served briefly with the New York
City mega -law firm of White &Case before returning to public service as a
prosecutor in the New City area. Herb continued his career in public service
upon relocating to Miami, Florida to accept a position as an Assistant State
Attorney with the Miami -Dade State Attorney's Office. During his many years as
an Assistant State Attorney, Herb tried hundreds of felony cases, never losing
a murder trial and being undefeated at trial during his last seven(7) years with
the office. Additionally, Herb traveled throughout the United States as a hiring
,mmittee recruiter for the office and served as a Division Chief and, notably,

handled many high -profile media cases including the Vega, Baby . iomicide and
the Church of Satan killer, Asa trial attorney, Herb's craft ,,ivas often televised
nationally and featured prominently on major news organs such as Court TV; CNN;
Fox News Network (national), Herb has served as a national commentator in the
area of trial litigation for Fox News and Court TV. Additionally, Herb served as
co -host along with Kimberely Guilfoyle on Court TV's trial analysis -related show:
"Both Sides", which capped a week-long Court TV holiday broadcast special
focusing the entire week on•one of Herb's recent homicide prosecutions. With
Herb in the New York City studios as guest cohost, this episode of the show
became the highest rated in Court TV history.
In addition to his courtroom and television appearances, has Herb has taught
criminal procedure and trial litigation techniques to law enforcement officers and
attorney's throughout the state of New Jersey on behalf of the New Jersey Attorney
General's Office, as well as throughout the state of Florida as a lecturer for the
Florida Prosecuting Attorneys Association. Herb has also acted as a lecturer to
undergraduate students and police officers on behalf of the Miami -Dade College
and the Miami Police Department's Police Academy and countless other academic
and community organizations, When his demanding schedule will allow, Herb
currently serves as an occasional "on air" legal expert for WFOR/CBS4 and many
)they local television and media outlets.
