I ain requesting that the First Amendment to the Interlocal Agreement between the City
of Miami, Miami -Dade County, and the Omni Redevelopment District Community
Redevelopment Agency ("First Amendment") be placed on the April 24, 2008 City
Commission agenda for ratification. The City Attorney has opined that ratification of the
First Amendment would eliminate alirlITO gar ing p acement of this item on the
Chy C mmission{s agenda last December. Additionally, Commissioner Regalado has
expressed concerns regarding whether an amendment of the redevelopment plan is
required to increase support for the Performing Arts Center ("PAC"). In light of these
issues, I believe that all of my colleagues on the commission should be present.
As an aside, over the years the Board of Commissioners of the Omni Redevelopment
District Community Redevelopment Agency ("CRA") has always voted prior to
transferring funds to Miami -Dade County, pursuant to the CRA's commitment to
partially fund construction of the PAC. At the March 31, 2008 CRA Board meeting, the
City Attorney, in her capacity as CRA General Counsel, advised that this is not required
and that payment to the County is due. While I respect the City Attorney's opinion, I
think it is important that the board have clarity before payment is made.
