Thompson City Clerk CFTY OF MIAMI OFFICE OF THE CITY ATTORNEY MEMORANDUM TO: FROM: DATE: RE: Lourdes Slazyk, Zoning Administrator �j�,�� Rafael Suarez -Rivas, Assistant City Attorney 1, October 4, 2006 Rescission of Class if Permits -Informal Legal Opinion Matter ID No.: 06-1900 Pursuant to your memorandum of September 29, 2006, a copy of which is attached, we offer the following response to your request for a legal opinion on the following issues of local govemment law: 1. Whether a Class II Special Permit may be rescinded based on either non- compliance with a condition for the approval of the permit or based on the permit being issued in enor, 2. Whether there are mechanisms exist to rescind a Class 11 Special Permit after the Permit has been issued and'once the period for appeal has lapsed, With respect to the first question you posed, it is true that a Class Ii Special Permit may be rescinded based on either non-compliance with a condition for approval or based on an error in the initial issuance of the permit. With respect to the second question you posed, there arc two different ways to rescind a Class II Special Permit once it has been issued and once the appeal period has lapsed. Although the planning director has the authority to issue Class II Special Permits, thc local legislative body —our City Commission has not bestowed the planning director with the authority to rescind the same. Instead, pursuant to Section 2109 of the Zoning Ordinance, both the Zoning Board and the City Commission are imbued with the authority to rescind Class It Special Permits once they have been issued. Ideally, the rescission of a Class 11 Special Permit is done through the grant of authority to the Zoning Board because their decision could be appealed to the City Commission. According to Section 2109.1.1 of the Zoning Code, the Zoning Board may rescind any resolution granting a special pemnit after the same hae been granted, if, after a public hearing by the director(s) of the planning, building and zoning department, the zoning board finds that there has been a violation of any conditions restrictions or limitations in thc subject resolution, The published notice for the public hearing must be equal to that the initial grant application (per Section 62.55 of the Code of the City of Miami) has fu-st been given. If the director refuses or fails to make such au application, upon written request of any aggrieved party, the aggrieved party may request the City Commission, through the City Manager, to instinct such director to do so. According to Section 2109.1.2. of the Zoning Code, the City Commission may rescind a resolution granting a special permit, if, after a public hearing by the director of the planning, Doc. Continued... building and zoning department, the City Commission finds that there has been a violation of any conditions, restrictions or limitations in the resolution. This public hearing may only be held upon published notice equal to that given for the initial grant application (per Section 62-55 of the Code of the City of Miami). Again, the failure or refusal of the director to make such an application upon written request of any aggrieved party, and entitles the aggrieved party to request that the City Commission, through the City Manager, instruct the director to do so. Additionally, the director may, on his own volition, review allthe proffered covenants for omissions and violations of omissions and violations of conditions and may initiate appropriate courses of action. In conclusion, a Class ['Special Permit can be rescinded for failure to comply with conditions of its granting. In order to obtain a rescission, the matter should be brought to the Zoning Board by the director or an aggrieved party, so that a public hearing can be held and the proper deteaminatioris can be made. Alternatively, the matter can be brought before the City Commission for the Same determination to be made. Please call this office if you have any questions, comments or concerns about this decision.
