La Comision de la Ciudad de Miami celebrard una Audiencia Ptiblica el 8 de mayo de
2008 comenzando a las 9:00 a.m. para considerar si es en el mayor interes del publico que la
Ciudad escoja consultores para proveer servicios adicionales para el PIan Maestro de Miami
21 por un metodo que no es licitacion competitiva de la siguiente manera:
• La Ciudad de Miami, Florida esta actualmente involucrada en un proyecto para
el planeamiento de la Ciudad entera conocido como el proyecto "Miami 21 Master
Plan". Los servicios adicionales consisten en preparacion para planeamiento adi-
cional, reuniones publicas, y servicios de disefio urbano para el proyecto titulado
"Citywide Miami 21 Master Plan", aumentando la cantidad autorizada por la Orden
de Trabajo por una cantidad que no esceda $510,000. La cantidad total estimada
basado en la propuesta entera del "Miami 21 Master Plan" es una cantidad que no
debe exceder $2,210,000.00.
La Ciudad de Miami propone escoger Duany Plater-Zyberk & Company, LLC formerly
known as Duany Plater-Zyberk & Company, Inc., Master Planners and Prime Consultant,
para proveer servicios adicionales del Planeamiento Urbano, reuniones publicas, y servicios
de Diseno Urbano para el Plan Maestro Miami 21. Esta accion sigue el juicio escrito del
Administrador de la Ciudad de una emergencia publics valida al efecto que el tiempo que se
require para un proceso de procuramiento competitivo y otorgamiento de contrato para dicho
proyecto crea una dificultad indebida para el bienestar publico, por to tanto es del mejor inte-
res publico para suspender los procedimientos de procuramiento competitivo. El
Administrador de la Ciudad investigo e identifico la firma como siendo excelentemente cali-
ficada para llevar a cabo este proyecto y teniendo un historial sustancial de experiencia en
proyectos de tal tamano y complejidad. El Administrador de la Ciudad tambien ha determi-
nado que dicha firma tiene las licencias adecuadas y esta certificada como consultora unica-
mente calificada para llevar a cabo este trabajo de parte de la Ciudad.
Esta accion se esta contemplando de acuerdo con la Seccion 287.055 de los Estatutos
de la Florida (Acta de Negociacion Competitiva de Consultores) y las Secciones 18-85
(Procedimientos de Suspension de Licitacion Competitiva), 18-87 (Servicios Profesionales
definidos en la Seccion 287.055 de los Estatutos de la Florida) y 18-90 (Procuramiento de
Emergencia) del Codigo de la Ciudad de Miami, enmendado. Los criterios para considerar en
este asunto estan delineados en la resolucion que ha sido propuesta y en estas Secciones del
Codigo y en la Seccion 287.055 de los Estatutos de la Florida, los cuales han sido incorpo-
rados por referencia aquf y estan disponibles como archivospublicos de la Ciudad de Miami.
La Audiencia Ptiblica sera celebrada en conjunto con la reunion de la comision de la
Ciudad programada para el 8 de mayo de 2008 en:

The Miami City Commission will hold a Public Hearing on May 8, 2008 beginning at 9:00 am to consider
whether it is in the public's best interest that the City select consultants to provide additional services for
the Miami 21 Master Plan by method other than competitive bid as follows:
The City of Miami, Florida is currently engaged in a Citywide town planning project known as the "Miami
21 Master Plan". The additional services consist of the preparation for additional Town Planning, public
meetings, and Urban Design services for the Citywide Miami 21 Master Plan, increasing the authorized
amount for the Miami 21 Work Order by an amount not to exceed $510,000. The total estimated cost
based on the entire scope of services proposal for the Miami 21 Master Plan is an amount not to exceed
$2,210,000.00.
The City of Miami proposes to select Duany Plater-Zyberk & Company, LLC formerly known as Duany
Plater-Zyberk & Company, Inc., Master Planners and Prime Consultant, to provide additional Town Plan-
ning, public meetings, and Urban Design services for the Miami 21 Master Plan. This action follows the
City Manager's written finding of a valid public emergency to the effect that the time required for the
competitive procurement and award of contract for said project creates an undue hardship on the public
welfare, thus it is in the best interest of the public to waive competitive procurement procedures. The
City Manager has investigated and identified the aforementioned firm as having excellent qualifications
distinctly geared to the aforementioned project and a substantial record of experience in projects of like
size and complexity. The City Manager has further determined that said firm is appropriately licensed
and certified as consultants uniquely qualified to undertake and perform the required work on behalf of
the City.
This action is being considered pursuant to Florida Statutes 287.055 (Consultant's Competitive Negotia-
tion Act) and Sections 18-85 (Competitive Sealed Bidding/Waiver Procedures), 18-87 (Professional Ser-
vices as defined in F.S. Section 287.055) and 18-90 (Emergency Procurements) of the Code of the City
of Miami, as amended. The criteria to be considered in this matter are set forth in the proposed resolution
and in these Code sections and in F.S. Section 287.055, which are deemed to be incorporated by refer-
ence herein and are available as public records from the City of Miami.
The Public Hearing will be held in conjunction with the regularly scheduled City commission meeting of
May 8, 2008 at:

descubrimlentos expresados por escrito del Administrador
de la Ciudad de, que existe una emergencia publica velida en el sentido de que el tiempo requerido para la obten-
cion de ofertas competitivas y el otorgamiento del contrato
para el antes citado proyecto crea un perjulcio al bienestar
publico, por to que resulta en el mejor interns publico el
sobreseer los procedimientos de obtencion de ofertas
competitivas. El administrador de la ciudad ha investigado
e indentificado a la firma` antes citada como poseedora
de excelentes calificaciones orientadas especificamente
al proyecto anteriormente citado y un excelente historial
de experiencia en proyectos del tamafto y complejidad
del presenter Adicionalmente, el Administrador de la Ci-
udad ha determinado que dicha firma este debidamente
certificada y licenciada como consultores singularmente
caliticados para hacerse cargo y eje,cutar el trabajo nec-
esario en beneficlo de la Ciudad.
Este action este siendo considerada de acuerdo con los
Estatutos de la Florida 287.055 (Consultant'sCompeti-
tive Negociation Act) y las Secciones 18-85 (Competitive
Sealed BiddingNVeiver Procedures), 18-87 (Profession-
al Services as defined in F.S.` Section 287.055) y 18-90
(Emergency Procurements) del COdigo de la Ciudad de
Miami, segunfue enmendado. Las rezones a considerarse
en esta asunto se consignan en la resolution propuesta y
