WAIVER OF COMPETITIVE BIDS AND
SELECTION OF CONSULTANTS FOR
VIRGINIA KEY MASTER PLAN
ADDITIONAL SERVICES
Miami, Florida
The Miami City Commission will hold a Public Hearing on February 28, 2008 beginning at 9:00 am to consider whether it is in the
public's best interest that the City select consultants to provide additional services for the Virginia Key Master Plan and the Historic
Virginia Key Beach Park Lands by method other than competitive bid as follows:
• Virginia Key is located within Biscayne Bay and traversed by the Rickenbacker Causeway midway between the City of Miami
mainland and the Village of Key Biscayne, Florida. The additional services consist of the preparation for additional planning
and design services for the island -wide master plan, Virginia Key Master Plan and planning services and a viability study
for the Historic Virginia Key Beach Park Lands. The total estimated cost based on the entire scope of services proposal is
$920,000.
The City of Miami proposes to select Edward D. Stone Jr. and Associates, Inc. D/B/A EDSA, Master Planners and Prime Consultant to
provide additional planning and viability study services. This action follows the City Manager's written finding of a valid public emergency
to the effect that the time required for the competitive procurement and award of contract for said project creates an undue hardship
on the public welfare, thus it is in the best interest of the public to waive competitive procurement procedures. The City manager has
investigated and identified the aforementioned firms as having excellent qualifications distinctly geared to the aforementioned project
and a substantial record of experience in projects of like size and complexity. The City Manager has further determined that said firms
are appropriately licensed and certified consultants uniquely qualified to undertake and perform the required work on behalf of the
City.
This action is being considered pursuant to Florida Statutes 255.20 and Section 18-90 (Emergency Procurements) of the Code of the
City of Miami. The criteria to be considered in this matter are set forth in the proposed resolution and in these Code sections, which are
deemed to be incorporated by reference herein and are available as public records from the City of Miami.
The Public Hearing will be held in conjunction with the regularly scheduled City commission meeting of February 28, 2008 at:

All interested persons may appear at the meeting and may be heard with respect to the proposed issue. Should any person desire to
appeal any decision of the City Commission with respect to any matter to be considered at this meeting, that person shall ensure that
a verbatim record of the proceedings is made including all testimony and evidence upon which any appeal may be based.
In accordance with the Americans with Disabilities Act of 1990, persons needing special accommodations to participate in this proceeding

La Junta de Comisionado de la Ciudad de Miami, cele-
brara una Audiencia Publica el 28 de febrero del 2008,
comenzando a las 9:00 A.M., para considerar si es en el
mejor interes publicoque la Ciudad selecciones consul
torespara proporcionar servicios adicionales para el Plan
Maestro de Virginia Key y Historic Virginia Key Beach Park
Lands mediante otro metodo que no sea el de oferta com-
petitive, como sigue:'
• Virginia Key este ubicado dentro de Biscayne Bay y
atravesado por el Rickenbacker Causeway, a mitad
de camino entre la tierra firme de la Ciudad de Miami y
la Villa de Key Biscayne, Florida. Los servicios adicio
hales consisten en al preparaciondeplanificacibnadicio-
nal y servicios de diseno para el plan maestro para
la totalidad de la isla, el Plan Maestro de Virginia Key
y servicios de planificacion y estudio de factibilidad
para las Tierras del Parque Playero de Virginia Key.
El costo estimado pars la totalidad de los servicios
propuestos es de $920,000.
La Ciudad de Miami se propone seleccionar a Edward D.
Stone Jr. and Associates, Inc. D/B/A EDSA, Planificadores
Maestros y Consultores Principeles para que proporcionen
servicios adicionales de planificacion y factibilidad. Esta
accion se basa en los descubrimientos expresados por
escrito del Administrador de la Ciudad de que existe una
emergencia publica v$lida en el sentido de que el tiempo
requerido para la obtencion de ofertas competitivas y el
otorgamiento del contrato para el antes citado proyecto
crea un perjuicio al bienestar publico, por to que resulta en
el mejor interas publico el sobreseer los procedimientos
de obtencion de ofertas competitivas. El administrador de
la ciudad ha investigado e indentificado a la firma antes
citada como poseedora de excelentes calificaciones orien-
tadas especificamente al proyecto anteriormente citado
y un excelente historial de experiencia en proyectos del
tamano y complejidad del presente. Adicionalmente, el Ad-
ministrador de la Ciudad ha determinado que dicha firma
este debidamente certificada y licenciada como consul-
tores singularmente calificados para hacerse cargo y eje-
cuter el trabajo necesario en beneficio de la Ciudad.
Este accion este siendo considerada de acuerdo con los
Estatutos de la Florida 255.20 y la Seccidn 18-90 (Emer-
gency Procurements) del Codigo de la Ciudad de Miami.
El criterio a ser considerado en este asunto como se este-
blece en la resolucidn propuesta y en estas secciones del
Codigo, que han de considerarse incorporadas mediante
referencia en las presentes actuaciones estan disponibles
como record publico de la Ciudad de Miami.
La Adudiencia Publica se celebrar3 conjuntamente con la
reunion ordinaria programada por la Ciudad para el 28 de
febrero del 2008, en:

Se invite a comparecer y ser oidas a todas las personas
interesadas en el asunto propuesto. Si alguna persona
deseara apelar cualquier decision de la Junta de Comi-
sionados en relacidn con cualquier asunto tratado en esta
audiencia, dicha persona debera asegurarse de que se
produzca una transcripcidn literal de las actuaciones, in-
