HomeMy WebLinkAboutR-07-0676City of Miami Legislation Resolution: R-07-0676 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01393 Final Action Date: 12/13/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT TERRORISM TASK FORCE STANDARD MEMORANDUM OF UNDERSTANDING ("MOU") WITH THE FEDERAL BUREAU OF INVESTIGATION ON BEHALF OF THE MIAMI POLICE DEPARTMENT AS A PARTICIPATING AGENCY, WITH SAID MOU SUBJECT TO TERMINATION AT WILL BY EITHER PARTY ON NOT LESS THAN SIXTY (60) DAYS PRIOR WRITTEN NOTICE. WHEREAS, within the United States, the Department of Justice, acting through the Federal Bureau of Investigation ("FBI"), is the lead agency domestically for deterring domestic and international terrorism and the FBI has requested the City of Miami ("City"), through its Police Department ("Department") to enter into a Joint Terrorism Task Force Standard Memorandum of Understanding ("MOU") as a participating agency in the Joint Terrorism Task Force; and WHEREAS, under Florida Statutes Chapter 163.01, "The Florida Interlocal Cooperation Act of 1969", the City and the FBI are both considered "public agencies" and the MOU will constitute an interlocal agreement setting forth each public agency's responsibilities in connection with the FBI's Joint Terrorism Task Force in order to leverage the collective resources of the member agencies for the prevention, pre-emption, deterrence, and investigation of terrorist acts and the apprehension of individuals who may commit or plan to commit such acts; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to execute a MOU with the FBI, on behalf of the Department as a participating agency, with said MOU subject to termination at will by either party with no less than sixty (60) days prior written notice. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
