A Resolution of the City of Miami Commission, with attachments, rescinding Res ,a lion 1-06-0725,
that authorized the City Manager to execute a Grant of Water Easement, with Mini -Dade County,
subject to Bayside Center Limited Partnership ("Bayside") executing a joinder to the Water -easement;
authorizing the City Manager to execute a Grant of Water Easement, in substantially the attached
form, with Miami -Dade County ("Grantee") for the purpose of granting Grantee the right to use
approximately a 12-foot wide water easement, at the property known as Bayfront Park, located at 401
Biscayne Boulevard, Miami, Florida, as more particularly described in Exhibit "A" attached hereto
and made a part hereof as a water easement.

Background Information:
On December 14, 2006, the City Commission approved Resolution R-06-0725 which granted Miami -
Dade County Water & Sewer Department a 12-foot wide water easement on City -owned property
known as Bayfront Park, located at 401 Biscayne Boulevard, Miami, Florida, a portion of which is
abutting Bayside Specialty Center, and subject to Bayside Center Limited Partnership executing a
joinder to the water easement. The 12-foot wide water easement is for water facilities installed for
Bayfront Park but was not granted when Bayside Marketplace Specialty Center was originally built.
Bayside has indicated it will not sign as a joinder to this water easement. Therefore, in accordance
with Section 2.3 of the Bayside Specialty Center Retail Lease, the City is exercising its rights as
owner to grant this easement. The easement will be for the construction, operation, and maintenance
of water facilities with the right to reconstruct, improve, change, and remove all or any of the facilities
within the easement, with full right of ingress thereto and egress therefrom..
