Subject: Airspace Agreement with Florida Department of Transportation for use of the area located
underneath 1-95 at N.W. 72nd Street, Miami.
Purpose of Item:
A Resolution of the City of Miami Commission, with attachments authorizing the City Manager to
execute an Airspace Agreement, in substantially the attached form, with Florida Depaitnient of
Transportation for the Public Works Department's use and occupancy of the area underneath I-95 at
NW 72nd Street, Miami (the "Property") for a term of three (3) years, with option to extend for an
additional one (1) year term, with no rental fee, and with terms and conditions more particularly set
forth in the Agreement.

Subject: Airspace Agreement with Florida Department of Transportation for use of the area located
underneath I-95 at N.W. 72nd Street, Miami.
Background Information:
Florida Department of Transportation ("FDOT") and the City of Miami ("City") have negotiated an
Airspace Agreement for the use property owned by FDOT located under I-95, near N.W. 72nd Street,
Miami, Florida.
The Airspace Agreement authorizes the Public Works Department of the City of Miami to use the
Property for parking and storage of its equipment and vehicles.
The term of the Permit Agreement is for three (3) years with an option to extend for one additional year.
There will be no rental fee charged by the FDOT. The City will be responsible for maintenance.
FDOT will retain responsibility of any replacement needs of the highway not caused by the negligence
of the City . FDOT retains the right to access the Property for routine maintenance and emergencies.
