Final Approvals (SIGN AND DATE) City Manager w�� AGENDA ITEM SUMMARY FORM CONTINUED Background Information: Pursuant to Ordinance No. 11908, adopted April 13, 2000, the Miami City Commission amended the Code of the City of Miami ("City") by allowing City employees to participate in the various affordable housing programs administered by the City through the HOME and SHIP programs without seeking a waiver. On July 16, 2004, the City of Miami Department of Community Development allocated $815,000 in CDBG funds for predevelopment costs associated with Ralph Plaza II. On September 24, 2007, the Department of Community Development requested from HUD a determination regarding the existence of a conflict of interest resulting from the purchase of Unit 1 by a City employee. HUD determined that a conflict of interest did exist regarding said purchase and that the conflict of interest provisions at 24 CFR 570.611(c) apply to the employee. The provisions of 24 CFR 570.611(d) allow the Department of Community Development to request an exemption to the provisions of 24 CFR 570.611(b) on a case -by -case basis by providing documentation to HUD about the nature of the conflict, accompanied by an assurance that there has been public disclosure including a description of how the public disclosure was made; and an opinion of the City's attorney that the interest for which the exemption is sought would not violate State or local law.
