DiTctor r Chief �� % 4) 1 City Manager / Pi g,e1 of AGENDA ITEM SUMMARY FORM CONTINUED Background Information: Pursuant to Resolution No. 05-0494, adopted July 28, 2005, the City Commission approved waiving the prohibitions contained in Section 2-612 and 2-614 of the City Code by a four -fifths (4/5ths) affirmative vote, as such prohibitions maybe applicable regarding the conveyance of certain City -owned properties to David Wilson and RERG Development, LLC ("RERG") and John Dixon and Miami Dream Homes for the construction of affordable housing in district 5. On November 7, 2006 the City Manger executed Quit Claim Deeds transferring the properties located at 1275 N.W. 58`h street, 1283 NW 58'h terrace, 1288 N.W. 58TH terrace, 1280 N.W. 59TH street, 1290 N.W. 59TH street, 1240 N.W. 59TH street, and 1241 N.W. 58TH terrace, Miami, Florida, to RERG Development, LLC. The Quit Claim Deeds required construction to start on the properties by May 7, 2007. RERG Development, LLC ("RERG") is requesting an extension to commence construction of the five (5) single family homes on the properties located at 1275 N.W. 58m street, 1283 N.W. 58`h terrace, 1288 N.W. 58`h terrace, 1280 N.W. 59'h street, and 1290 N.W. 59'h street, Miami, Florida, due to the length the time it took to get the plans approved by the Building Department. The plans have been approved by the Building Department and RERG is ready to pull permits to begin construction for four (4) single family homes to be located at 1275 N.W. 58`h street, 1283 N.W. 58'h terrace, 1288 N.W. 58m terrace, and 1280 N.W. 59'h street, Miami, Florida. The plans for the fifth single family home to be located at 1290 N.W. 59'h street are currently in the permitting process. RERG is also requesting an extension to commence construction of twelve (12) townhomes on the properties located at 1240 N.W. 59'h street, and 1241 N.W. 58'h terrace, because the properties are much more conducive to the construction of townhomes instead of single family homes. The Administration recommends granting RERG Development, LLC.: (1) an extension of time, until February 1, 2008 to commence construction on the properties located at 1275 N.W. 58`h street, 1283 N.W. 58'h terrace, 1288 N.W. 58'h terrace, 1280 N.W. 59'h street, and 1290 N.W. 59'h street, Miami, Florida, legally described on Exhibit "A" attached and incorporated (collectively, the "properties"; individually, a "property"), for the construction of five (5) single family homes; (2) an extension of time, until July 1, 2008 to commence construction on the properties located at 1240 N.W. 59'h street, and 1241 N.W. 58'h Terrace, Miami, Florida, legally described on Exhibit "B" attached and incorporated (collectively, the "properties"; individually, a "property"), for the construction of twelve (12) townhomes.
