A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), GRANTING TO RERG DEVELOPMENT, LLC. : (1) AN EXTENSION OF TIME, UNTIL FEBRUARY 1, 2008, TO COMMENCE CONSTRUCTION ON THE PROPERTIES LOCATED AT 1275 NORTHWEST 58TH STREET, 1283 NORTHWEST 58TH TERRACE, 1288 NORTHWEST 58TH TERRACE, 1280 NORTHWEST 59TH STREET, AND 1290 NORTHWEST 59TH STREET, MIAMI, FLORIDA, LEGALLY DESCRIBED ON EXHIBIT "A," ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION OF FIVE (5) SINGLE FAMILY HOMES, AND (2) AN EXTENSION OF TIME, UNTIL JtrJLY 1, 2008, TO COMMENCE CONSTRUCTION ON THE PROPERTIES LOCATED AT 1240 NORTHWEST 59TH STREET, AND 1241 NORTHWEST 58TH TERRACE, MIAMI, FLORIDA, LEGALLY DESCRIBED ON EXHIBIT "B," ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION OF TWELVE (12) TOWNHOMES; STATING THE INTENTION OF THE CITY COMMISSION RELATED TO CONVEYANCE OF TITLE TO SAID PROPERTIES; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR SAID PURPOSES. WHEREAS, pursuant to Resolution No. 05-0494, adopted. July 28, 2005, the City Commission approved waiving the prohibitions contained in Sections 2-612 and 2-614 of the Code of the City of Miami, Florida, as amended, by a four -fifths (4/5ths) affirmative vote, as such prohibitions may be applicable regarding the conveyance of certain City of Miarrii, ("City") owned properties to David Wilson and RERG Development, LLC ("RERG") and John Dixon and Miami Dream Homes for the construction of affordable housing in District 5; and WHEREAS, on November 7, 2006, the City Manger executed Quit Claim Deeds transferring the properties located at 1275 Northwest 58th Street, 1283 Northwest 58th Terrace, 1288 Northwest • 58th Terrace, 1280 Northwest 59th Street, 1290 Northwest 59th Street, 1240 Northwest 59th Street, and 1241 Northwest 58th Terrace, Miami, Florida, to RERG; and WHEREAS, the Quit Claim Deeds required construction to start on the properties by May 7, 2007; and WHEREAS, RERG is requesting an extension to commence construction of the five (5) single family homes on the properties located at 1275 Northwest 58th Street, 1283 Northwest 58th Terrace, 1288 Northwest 58th Terrace, 1280 Northwest 59th Street, and 1290 Northwest 59th Street, Miami, Florida, due to the length the time it took to get the plans approved by the Building Department; and WHEREAS, the plans have been approved by the Building Department and RERG is ready to pull permits to begin construction for four (4) single family homes to be located at 1275 Northwest 58th Street, 1283 Northwest 58th Terrace, 1288 Northwest 58th Terrace, and 1280 Northwest 59th Street, Miami, Florida; and Cirp of Miami Page 1 of 3 Primed 0n: 9/J 0/2007 File Number. 07-01146 WHEREAS, the plans for the fifth single family home to be located at 1290 Northwest 59th Street, Miami, Florida, are currently in the permitting process; and WHEREAS, RERG is also requesting an extension to commence construction of twelve (12) townhomes on the properties located at 1240 Northwest 59th Street, and 1241 Northwest 58th Terrace, Miami, Florida, because the properties are much more conducive to the construction of townhomes instead of single family homes; and WHEREAS, the Administration recommends granting RERG: (1) an extension of time, until February 1, 2008, to commence construction on the properties located at 1275 Northwest 58th Street, 1283 Northwest 58th Terrace, 1288 Northwest 58th Terrace, 1280 Northwest 59th Street, and 1290 Northwest 59th Street, Miami, Florida, legally described on Exhibit "A," attached and incorporated, for the construction of five (5) single family homes; and (2) an extension of time, until July 1, 2008 to commence construction on the properties located at 1240 Northwest 59th Street, and 1241 Northwest 58th Terrace,•Miami, Florida, legally described ion Exhibit "B," attached and incorporated, for the • construction of twelve (12) townhomes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. RERG is granted: (1) an extension of time, until February 1, 2008, to commence construction on the properties located at 1275 Northwest 58th Street, 1283 Northwest 58th Terrace, 1288 Northwest 58th Terrace, 1280 Northwest 59th Street, and 1290 Northwest 59th Street, Miami, Florida, legally described on Exhibit "A," attached and incorporated, for the construction of five (5) single family homes, and (2) an extension of time, until July 1, 2008 to commence construction on the properties located at 1240 Northwest .59th Street, and 1241 Northwest 58th Terrace, Miami, Florida, legally described on Exhibit "B," attached and incorporated, for the construction of twelve (12) townhomes. Section 3. It is the intention of the Miami City Commission that title to said properties described above and on Exhibits "A" and "B," shall be deemed to have remained with RERG from the date of conveyance. Section 4. The City Manager is authorized{1} to execute to execute all necessary documents for said purposes. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JORGE IL.
