Subject: resolution Granting three Liasernent to Florida. Department of Transportation
Purpose of item:
The administration recommends that the Miami City Commission adopt the attached Resolution
authorizing the City Manager to execute a grant of easements, in substantially the forms attached,
relating to the Port of Miami Tunnel and. Access improvement Project ("PROJF.CT") to the Florida
Department of 'Transportation ("F DOT") one (1) temporary construction casement containing
approximately 4.39 acres, and two (2) perpetual easements containing approximately 2.51 and 1.79
acres respectively, on the properties described in the casement agreements as more particularly
described in Exhibit "A" attached hereto and made a part hereof, all as provided in the Master
Agreement among the Florida Department of Transportation ("FDOJ"), Miami -Dade County
j("MDC"), and the City of Miami (" C1.1"Y").

SUPPLEMENTAL SHEET
Subject: Resolution Granting... Easement to Florida Department or Transportation
Background Information:
The Florida Department of Transportation ("FDOT") proposes to construct and/or improve portions
of State Road A-1-A, Section No. 2511562, to develop the Part of Miami une1 and Access
Tmprovement Project ("Project"). The Project will connect MacArthur Causeway to the fort of
Miami. FDOT requires certain lands owned by the City to be used for both permanent and temporary
uses during the construction of the Project located on Watson Island.
The Department has requested the City execute and deliver the following easements: (l) a perpetual
nun -exclusive casement of approximately 2.51 acres for the construction, operation, use and
maintenance ofa permanent tunnel envelope, with the right to protect the integrity of the Project; (2) a
perpetual non-exclusive easement of approximately ] .79 acres for the construction and maintenance
of a permanent tunnel envelope to protect the integrity of the Project; and (3) a temporary non-
exclusive easement of approximately 4.39 acres to be shared by FDOT and Flagstone Island Gardens
("Flagstone") for (i) constriction staging and handling of soil and other materials during the
construction of the Project by FDOT; and (ii) parking in an amount not to exceed one hundred (100)
vehicles related to the construction aFlagstone.
In the event FDOT does not complete construction of the Project by July 1, 2015 or at any time after
commencement of operation of the Project abandons the Project, the perpetual easements shall revert
back to the City. The temporary easement shall became valid upon the date FOOT becomes owner of
this easement. FDOT must give notice to the City not less than sixty (60) days previously to
beginning any work in the area. Upon completion of the Project the temporary casement shall revert
back to the City_
