A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
RELATING TO THE PORT OF MIAMI TUNNEL AND ACCESS IMPROVEMENT
PROJECT ("PROJECT"), AUTHORIZING THE CITY MANAGER TO GRANT TO THE
FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") ONE (1) TEMPORARY
CONSTRUCTION EASEMENT CONTAINING APPROXIMATELY 4.39 ACRES, AND
TWO (2) PERPETUAL EASEMENTS CONTAINING APPROXIMATELY 2.51 ACRES
AND 1.79 ACRES, RESPECTIVELY, ON THE PROPERTIES DESCRIBED IN THE
EASEMENT AGREEMENTS, ATTACHED AND INCORPORATED, ALL AS
PROVIDED IN THE MASTER AGREEMENT AMONG THE FDOT, MIAMI-DADE
COUNTY, AND THE CITY OF MIAMI; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE SAID EASEMENT AGREEMENTS, IN SUBSTANTIALLY
THE ATTACHED FORMS.
WHEREAS, the City Commission has authorized the execution of a Master Agreement among the
Florida Department of Transportation ("FDOT"), Miami -Dade County ("County"), and the City of Miami
("City") for the Port of Miami Tunnel and Access Improvement Project ("MASTER AGREEMENT"); and
WHEREAS, the Master Agreement requires the City to grant to FDOT one (1) temporary
construction easement and two (2) perpetual easements, on the properties described in the
Easement Agreements attached to the Master Agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to grant to the FDOT, one (1) temporary
construction easement containing approximately 4.39 acres, and two (2) perpetual easements
containing approximately 1.79 acres and 2.51 acres, respectively, on the properties described in the
Easement Agreements, attached and incorporated, all as provided in the Master Agreement among
the FDOT, the County and the City.
Section 3. The City Manager is authorized{1} to execute the Easement Agreements, in
substantially the attached forms.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
