Re: luterlocal for Ponce Professional Plaza Development

Dear Mr. Ferro,
Pursuantto our meeting this morning regarding the lnterlocal agreement between
the City of Miami and Coral Uabies for the Ponce Professional Plaza development
project located at 102-118 Ponce de Leon' (also utilizing the property located at 3690
West Flagler within the city limits oldie City of Miami), this is to confirtn the following:
Pursuant to Section 910 of Ordinance; 11000, as atnended, a covenant in lieu of
unity of title may be accepted for these properties so that they can be considered one
parcel for zoning purposes. This means that the FAR allowed for each site may be
distributed anywhere within the site as long as the total capacity for the combined sites is
not exceeded. This also means that the City of Miami site may exceed its allotted FAR
subject to the covenant in lieu of unity of title without need for a MUSP for this
additional FAR since the properties are bound together by covenant, However, a MUSP
will be required pursuant to Article 17 of ordinance 11000 if any of the proposed
development thresholds are exceeded as set out in the code; other than FAR as stated
listed in Article 5 for PUD and Section 914 for Affordable 1-lousing Trust Fund
contribution) however, will require a MUST.
