Fernanc}e�l,,; �� Adrne y DATE: November 27, 20007/ RE: Proposed Settlement for City Commission Meeting — December 13, 2007 Mary Conway vs. City of Miami (File No. 07-01243) The attached proposed Resolution seeks authorization for settlement of all claims against the City of Miami in the above -referenced matter, in the total amount of $200,000. The claimant initiated an investigation which revealed that several employees working in Capital Improvement Projects, were doing personal work on City time and using City resources. This resulted in the arrest of several employees and considerable publicity. The claimant was terminated shortly thereafter. The claimant is alleging that she was terminated in violation of Florida's Whistleblower Act and that the publicity surrounding her termination impacted her ability to find other comparable employment. A Whistleblower claim would expose the City to back pay, front pay, and payment of attorney's fees. The parties were able to reach a settlement, subject to City Commission approval, in the amount of $200,000. The Office of the City Attorney has investigated and evaluated this case and has approved the recommendation of this settlement. Funds in the amount of $200,000 will be allocated from the Self -Insurance and Insurance Trust Fund, Index Code No. 05002.301001.545000.0000.00000. Attachment(s) cc: Pedro G.
