HomeMy WebLinkAboutR-07-0711City of Miami Legislation Resolution: R-07-0711 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01398 Final Action Date: 12/13/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 (A) (1) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND APPROVING THE PROCUREMENT OF ELEVATOR MAINTENANCE AND REPAIRS AT THE MIAMI RIVERSIDE CENTER ("MRC") ADMINISTRATIVE BUILDING/GARAGE, FROM SCHINDLER ELEVATOR CORPORATION, INC.; AUTHORIZING THE CITY MANAGER TO EXECUTE A PREVENTIVE MAINTENANCE/SERVICES AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR A PERIOD OF FIVE (5) YEARS, WITH THE OPTION TO RENEW FOR ANOTHER FIVE (5) YEAR PERIOD, IN AN ANNUAL AMOUNT NOT TO EXCEED $39,000, FOR THE FIRST YEAR, WITH A PRICE ADJUSTABLE CLAUSE OF NOT MORE THAN 5% FOR THE SUBSEQUENT YEARS; ALLOCATING FUNDS FROM THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION, MRC DIVISION, ACCOUNT CODE NO. 05001.243000.546000.0000.00000. WHEREAS, the Department of General Services Administration, MRC Division is seeking to procure elevator maintenance and repair services for elevators located at the Miami Riverside Center ("MRC") Administrative Building and Parking Garage; and WHEREAS, the Schindler Elevator Corporation, Inc. ("Schindler") manufactured and installed the existing MRC elevators and has maintained the elevators since the building's inception; and WHEREAS, certain critical parts continue to be proprietary to Schindler and can only be provided by them; and WHEREAS, the services will include the replacement of existing parts with original manufacturer's equipment as needed; and WHEREAS, the elevators can only be monitored, operated, and trouble-shooted with the proprietary software along with the electronic elevator system installed and owned by Schindler; and WHEREAS, the equipment and functionality is necessary to ensure public safety and promote reliability to allow the general public continued access to the different municipal services provided by the City of Miami ("City") at the MRC; and WHEREAS, the Chief Procurement Officer has adopted a finding that Schindler is the sole source provider for this service; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as City of Miami Page 1 of 2 File Id: 07-01398 (Version: 1) Printed On: 4/20/2017 File Number: 07-01398 Enactment Number: R-07-0711 the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive formal sealed bids be waived pursuant to Section 18-92(a) (1) of the Code of the City of Miami, Florida, as amended ("City Code"), and the procurement of the above services as specified be approved as a sole sources, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92 (a) (1) of the City Code, after an advertised public hearing, the City Manager's finding of a sole source, waiving the requirements for competitive bidding procedures are ratified, approved and confirmed, and the procurement of Elevator Maintenance and Repairs at the MRC Administrative Building/Garage from Schindler, is approved. Section 3. The City Manager is authorized{1} to execute a Preventive Maintenance/Services Agreement, in substantially the attached form, for a period of five (5) years, with the option to renew for another five (5) year period, in an annual amount not to exceed $39,000, for the first year, with a price adjustable clause of not more than 5% for the subsequent years, with funds allocated from the Department of General Services Administration, MRC Division, Account Code No. 05001.243000.546000.0000.00000. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
