HomeMy WebLinkAboutMemo1CITY OF MIAMI, FLORIDA Glenn Marcos TO : Director of Purchasing FROM : Terry Byrnes, CPPB Senior Procurement Specialist etlAMINKMENIMIMMIWYMBOMPFIWIMArnalrnA INTER -OFFICE 'MMO "I NDU'M DATE: II MI I Mrou October 22, 2007 FILE : Sole Source: Elevator Maintenance SUBJECT : Repairs at Miami Riverside Center Administrative Building and Parking Garage REFERENCES: ENCLOSURES: I conducted an investigation to determine whether Schindler Elevator Corporation, Inc., located at 13800 N.W. 2 Avenue, Sunrise, Florida, 33325, is the sole source provider for elevator preventative maintenance and on -call services at the Miami Riverside Center (MRC) Administrative Building. The General Services Administration/MRC Division supports the continuation of Schindler Elevator Corporation, Inc. ("Schindler") to provide preventive maintenance and required elevator services at the MRC. The sole source investigation has revealed that Schindler manufactured and installed the existing MRC elevators and has maintained the maintenance of the elevators since the building's inception. Certain critical parts continue to be proprietary to Schindler and can only be provided by them. Consequently, the services will include the replacement of existing parts with original manufacturer's equipment as needed. Furthermore, the elevators can only be monitored, operated, and trouble-shooted with the proprietary software along with the electronic elevator system installed and owned by Schindler. The equipment compatibility and functionality is necessary to ensure public safety and promote reliability to allow the general public continued access to the different municipal services provided by the City at the MRC. Based on the foregoing, it is recommended pursuant to Section 18-92(a) (1), that the determination of a sole -source purchase be rendered by the Chief Procurement Officer and that the City Manager support said finding herein and respectfully recommend for the City Commission to ratify both the Chief Procurement Officer and City Manager's decision by an affirmative four -fifths vote. Both signatures below will affirm the sole source decision by both the Chief Procurement Officer and City Manager. It also recommended that the City Commission authorize the City Manager execute a preventive maintenance/services agreement with an price adjustable clause between the City of Miami and Schindler, for a period of five (5) years with the option to renew for another five (5) period, for an annual amount not to exceed $39,000 for the first year with the possibility of increases not more than 5% for each of the remaining four (4) years of the base term and five (5) years of the renewal term, unless terminated by either party with ninety (90) days written notice before contract renewal. This recommendation is subject to the availability of funds and budgetary approval utilizing the General Services Administration, MRC Division, Account Code No. 0 .243000.546000.
