HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01301 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PURCHASE OF REPAIR SERVICES FOR THE FIRE -RESCUE 3 VEHICLE, FROM MEDTEC AMBULANCE CORPORATION (THE MANUFACTURER) AND/OR TEN-8 FIRE EQUIPMENT, INC., MEDTEC'S SOLE AUTHORIZED REPRESENTATIVE AND DISTRIBUTOR FOR THE STATE OF FLORIDA, IN A TOTAL AMOUNT NOT EXCEED $121,505; ALLOCATING FUNDS FROM ACCOUNT CODE NO. P-18-109001, T-01.01, A-1017, E-EQUIPMENT, 0-184010. WHEREAS, on April 25, 2006, the Fire -Rescue 3 Vehicle, manufactured by Medtec Ambulance Corporation ("Medtec"), was purchased utilizing the Florida Sheriff's Association Contract No. 05-06- 0823, for an approximate total purchase price of $201,933, from Ten-8 Fire Equipment Inc.; and WHEREAS, on May 11, 2007, the Fire -Rescue 3 Vehicle was involved in an accident resulting in severe damage to the patient compartment box and the chassis and has been rendered inoperable; and WHEREAS, the Department of Fire -Rescue has a critical need to repair the Fire -Rescue 3 assigned to Fire Station No. 3, located at 1103 Northwest 7th Street, Miami, Florida; and WHEREAS, pursuant to Section 18-92(1) of the Code of the City of Miami, Florida, as amended ("City Code") sole source awards may be made under the circumstance that the replacement parts permits one reasonable source of supply; and WHEREAS, Medtec was the manufacturer of the Fire -Rescue 3 Vehicle and Ten-8 Fire Equipment, Inc. is Medtec's sole authorized representative/distributor for the State of Florida, and therefore, this vehicle can only be repaired by Medtec via the request of the original seller and sole authorized representative/distributor for the State of Florida, Ten-8 Fire Equipment, Inc.; and WHEREAS, the Chief Procurement Officer has adopted a finding that Medtec (the manufacturer) and/or Ten-8 Fire Equipment, Inc. are the sole source provider(s) to perform said repairs; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended ("City Code"), and the procurement of the above repair City of Miami Page 1 of 2 Printed On: 11/28/2007 File Number: 07-01301 services as specified be approved as a sole source; NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City Code, after an advertised public hearing, the City Manager's finding of a sole source, waiving the requirements for competitive sealed bidding procedures, is ratified, approved and confirmed and the purchase of repair services to the Fire -Rescue 3 vehicle from Medtec (the manufacturer) and/or Ten-8 Fire Equipment, Inc., Medtec's sole authorized representative and distributor for the State of Florida, in a total amount not exceed $121,505, is approved, with funds allocated from Account Code No. P-18- 109001, T-01.01, A-1017, E-Equipment, 0-184010. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1 } APPROVED AS TO FORM AND CORRECTNESS: JORGE L. CITY ATTO Footnotes: {1) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
