Purpose of Item: — To request approval of the attached resolution, by a four -fifths affirmativevote adopting the City Manager's finding of an emergency, waiving competitive bidding procedures, waiving the protest period and approving the use of a competitive negotiations procurement method and to authorize the City Manager to execute an Agreement with Dreams Products, Inc. d/b/a Mounted Memories. This resolution further authorizes the City Manager to execute an agreement with Schneider Industries, Inc. in the event Mounted Memories does not execute the negotiated agreement within 7 days of Commission approval. Background Information: On 10/30/07, the Department of Capital Improvements (CIP) issued a Request for Letters of Interest (RFLI) No. 06-07-040 for the purpose of creating a short-list of firms in order to competitively negotiate an Agreement for Asset Investment Recovery services for the Orange Bowl Stadium Demolition. On 11/9/07, five (5) submittals were received in response to the RFLI. The evaluation committee met on 11/13/07 to review and develop a short-list of firms. It was decided that it was in the best interest of the City that all 5 firms, Atkinson Real Estate & Auction, Cowan Alexander, LLC, Great American Group, LLC, Mounted Memories, and Schneider Industries, Inc., should be invited to continue with the selection process. On 11/20/07, CIP issued a Request For Information (RFI) No. 07-08-002 . The RFI requested that the firms submit detailed information from which the City could determine their capability to successfully market and sell Orange Bowl assets, creativity, ability to perform quickly, and ability to generate revenues. One firm decided not to pursue hiring and another two firms formed a prime/sub consultant relationship, which resulted in three (3) firms submitting responses to the RFI on 11/30/07. Director City Manager Page 1 of 1 Background Information Continued.... CIP conducted negotiations during the week of December 3, 2007. Based on the results of the negotiations, the City Manager determined that Mounted Memories offers the City the most advantageous agreement based on a combination of experience, plan, quality and potential revenue generation to the City. In the event that Mounted Memories does not execute the negotiated agreement within 7 days of Commission approval, the City will still need to maintain the aggressive project schedule; therefore this item further authorizes the City Manager to execute an agreement with Schneider Industries, the next most qualified firm. To accomplish this it is necessary to waive the competitive sealed bidding proposal process and the protest period as permitted by City Code Section 18-90 and 18-104(a). The City Manager has made a written finding justifying this action. There is no City expenditure of funds associated with the execution of the agreement. Poe 7 of 1
