City Manager DATE: December 6, 2007 FILE: B-30153F SUBJECT: Committee Recommendation: Orange Bowl Demolition - General Contracting Services FRO '¥ Gary Fabrikant, Assistant Director REFERENCES: RFLI No. 06-07-031 Department of Capital Improvements RFI No. 07-08-003 ENCLOSURES: An Evaluation Committee comprised of the following individuals reviewed the submittals, developed a short list of firms from which to solicit additional information and met with the demolition contractors: Lori Billberry, Director, Department of Public Facilities Gary Fabrikant, Assistant Director, Department of Capital Improvements Meredith Nation, Contracts Manager, Department of Capital Improvements James Cowdery, Orange Bowl Program Manager, Jones Lang LaSalle Doug Kuster, Project Architect, HNTB, Inc. The Committee was impressed by several of the original fifteen (15) Letters of Interest received from general contacting firms, but determined that three (3) of the firms had the most extensive experience with similar complex projects combined with the requisite staffing and financial capacity to complete the Orange Bowl demolition on the City's accelerated schedule. Based on these factors, the committee solicited detailed information from the three short listed firms regarding their: Management plan; Organizational structure; Project staff; Subcontracting plan including local small/minority business participation; Reporting plan; Schedule; Permitting and regulatory compliance plan; Financial control plan; Contracting plan; Technical approach; The selected firms were given a very short timeframe to provide all of the information requested and each was able to present their plans in the allotted timeframe. The Committee evaluated the firm submittals on the level of detail provided that was specific Page 1 of 3 to the Orange Bowl project and examples provided from similar prior projects. After reviewing all of the submittals, the Committee met with each firm for a total of three hours. During the meetings, firms were given an opportunity to further explain their management philosophy, provide details of their technical approach to the demolition process, justify their pricing, clarify their scheduling assumption and identify any problems they perceived with the work. The Committee members asked extensive questions during the meetings and felt that ample time was allotted to completely understand each of the firm's capabilities. Any of the firms who competed during this competitive negotiation process could successfully demolish the Orange Bowl for the City of Miami. The Committee was unanimous in their opinion that Decommissioning & Environmental Management Company, Inc. (DEMCO) provides the best combination of technical expertise, staff experience, scheduling flexibility and price. Only DEMCO presented the City with numerous technical and scheduling approaches, offering the greatest level of flexibility to the City. DEMCO clearly stated that they would be able to perform their work in various timeframes, with varied sequencing, with the ability to quickly change course as the project dictated. While the City is actively negotiating the redevelopment of the Orange Bowl site and while many details of our needs and timing remain unknown, the flexibility DEMCO, offers is vitally valuable. Additionally, only DEMCO offered the City an incentive program whereby the City controls the final retainage funds of which the disbursement will be allocated based on performance of the following indicators: Overall project performance Project safety Minority subcontracting goals First source hiring DEMCO will assign Walter C. Lieneck, PMP to manage this project. Mr. Lieneck is a Project Management Professional certified by the Project Management Institute. Mr. Lieneck has more than 28 years of progressive experience in engineering construction, project management, cost estimating, project design and procurement management with large Architectural/Engineering firms and General Contractors. Most recently Mr. Lieneck has been assigned to a $4.5 Million dismantlement of a Methanol Unit at an oil company refinery. Mr. Lieneck will be supported on site by a Site Safety Manager and General Superintendent with whom he has worked together on similar complex projects. Additional project support will be provided off -site by the President, VP of Operations and Corporate Health and Safety Director. The Project Team has presented excellent qualifications and represented a culture of safety and teamwork. In addition to the DEMCO staff, DEMCO will subcontract with several local firms to provide services such as security, temporary laborers, sod removal, CFC removal and recycling, and others to the extent feasible. DEMCO has been provided with the City's list of registered Minority/Women Business Enterprises (M/WBE) as well as the Page 2 of 3 County's list of Community Business Enterprises (CBE). DEMCO has had early conversations with several firms and has agreed to exceed the City's goal of providing 10% participation from M/WBE or CBE firms. Brandenburg Industrial Service Company (Brandenburg) and Cleveland Wrecking Company (Cleveland) deserve discussion as they are excellent firms that aggressively competed for this work. Brandenburg was not selected based on the competitive nature of the process. They were well qualified to perform the work however ultimately the decision was made to hire DEMCO who offered a 17% savings in fees. Cleveland was not selected based on several factors. Their submittals did not provide ample detail specific to the Orange Bowl project which made their technical approach and management plan harder to evaluate. Cleveland stated clearly that their proposed five (5) month schedule was firm and could not be adjusted. Additionally, Cleveland expressed apprehension regarding the removal of the historic elements at the stadium. The demolition scope of work includes the safe removal of the artistic murals and other historic items that adorn the stadium. Any trepidation over successfully completing this task, of critical importance to the City, was cause for Committee concern. Finally, all of the contractual concerns were not able to be resolved during the negotiations. The Committee is very pleased with the outcome of the competitive negotiation process and encourages the approval of the recommended firm. In the event that DEMCO does not sign the negotiated agreement within seven (7) days of Commission approval, the Committee recommends entering into an agreement with Brandenburg. Your signature below will signify your concurrence with the above recommendation and your assimilation of these findings as your own justification for the waiver of competitive bids and the selection of the specified firm.
