HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution: R-07-0716 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01455a Final Action Date:12/13/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE OMNI DISTRICT COMMUNITY REDEVELOPMENT AGENCY, THE SOUTHEAST/OVERTOWN PARK WEST COMMUNITY REDEVELOPMENT AGENCY, THE CITY OF MIAMI AND MIAMI-DADE COUNTY RELATIVE TO THE IMPLEMENTATION AND FUNDING OF PROJECTS OF GREAT INTEREST TO ALL PARTIES. WHEREAS, the Omni District Community Redevelopment Agency ("Omni CRA"), the Southeast Overtown/Park West Community Redevelopment Agency ("SEOPW CRA") the City of Miami ("City") and Miami -Dade County ("County") wish to enter into an Interlocal Agreement (the "Agreement"), in the form attached hereto as Exhibit "A" to: (i) increase the Omni CRAts financial support for the Miami Performing Arts Center ("PAC") to redirect the current use of the Tourist Development Tax ("TDT") and Convention Development Tax ("CDT") to provide additional funding for the Baseball Stadium and redevelopment of the Orange Bowl Stadium; (ii) extend the term, and expand the boundaries of the Omni CRA to include, among other areas, Bicentennial Park and Watson Island; (iii) provide funding for the Port Tunnel and Museum Park Projects; (iv) extend the life of the SEOPW CRA through the year 2030 and expand its boundaries to include, at a minimum the property described in Exhibit "B" to the Agreement; (v) beginning in fiscal year 2014, cap the utilization of SEOPW CRA tax increment revenues derived from the projects listed in Exhibit "C" to the Agreement, to 50% of the 2007 forecasted revenues for such projects; (vi) provide for County's financial contribution to the Streetcar Project; (vii) consider the extension of the reverter date of the properties described in Exhibit "D" to the Agreement, or, if the reverter has occurred, consider the reconveyance of said properties to the City; (viii) waive any and all claims the County may have to approve the budgets of the SEOPW and Omni CRAs for prior years; and (ix) waive any and all rights the County may have to charge an administrative fee to the SEOPW and Omni CRAs; NOW, THEREFORE, BE IT RESOLVED, BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2. The City Manager is authorized{1} to execute an lnterlocal Agreement, in substantially the attached form, between the Omni CRA, the SEOPW CRA, the City of Miami and Miami -Dade County, and all other documents described therein or attached to the Agreement. Section 3. The City Manager is directed to work with the Commissioners to develop a spending plan to allocate the City's portion of the SEOPW CRA tax increment revenues returned to the City's General Fund, as contemplated in paragraph 5.c. of the Agreement, to the poor neighborhoods of the City of Miami. Section 4, This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JORGE t.. `FEES CITYATT4 R4EY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. if the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
