This application is intended to serve as a guide in acquainting you with our public hearing process. By any means, please feel free to contact us at the number above, should you have any questions. CITY OF MIAMI ORDINANCE NO, 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION, A COPY OF SAID ORDINANCE IS AVAILABLE IN THE OFFICE OF THE CITY CLERK (MIAMI CITY HALL), LOCATED AT 3500 PAN AMERICAN DRIVE, MIAMI, FLORIDA, 33133. Copies of lobbyist documentation with proof of payment must be submitted with the complete application. The deadline to file the complete application with supporting documents is the first five working days (1-5) of each month from 8:00 am until 3:00 pm, and on the fifth day, at 12:00 pm. The responses to this application must be typed and signed in black ink. Please note that pursuant to Section 1304.2.2 of the Miami Zoning Ordinance, no application shall be deemed to have been filed unless and until the applications shall have been completed. All pertinent and accurate information/documentation; i.e., the plans, .reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt. The applicant is responsible for the accuracy of the information contained in the application and all supporting materials. If you like, you could bring the materials to our office for staff review before the deadline to ensure the application is complete. You will be responsible, if needed, to bring an interpreter for the English language to any presentation before city boards, committees and the city commission. A valid power of attorney will be required if neither applicant or legal counsel representing the applicant execute the application or desire to make a presentation before city boards, committees and the city commission. I have been advised that an Application for Closure and Vacation of Public Right -of -Way has been filed by the Owner with the Hearing Board's Office of the City of Miami with respect to the alleyway (approximately 10 feet in width) that is identified as "unlabeled alley" on the Plat of MIRAMAR THIRD AMENDED (PB 5, PG 64) and which lies within the boundary of said plat and is described on Exhibit "B" attached hereto. I further understand that all documents in conjunction with the Application have been properly filed with said Department. It is my further understanding that the City of Miami has requested an Opinion as to the ultimate ownership of the portions of the 10' alley lying between Lots 5 through 10, Block 9, of MIRAMAR THIRD AMENDED, PB 5, PG 64 and Tract 1 of AMENDED PLAT OF LES 3 M1A1V1[ 1352173.2 7689827917 VIOLINS SUBDIVISION, PB 109, PG 16, both of the Public Records of Miami -Dade County, Florida and dividing the Property as shown on the tentative plat upon being vacated as a result of such Application for Closure and Vacation of Public Right -of -Way and replotting of the Replatted Property ("Proposed Closed Right of Way"). DISCUSSION Il, The legal description of the Property consists of the lots or parcels described on Exhibit "A" hereto and such lots or parcels lying within the following two (2) plats: (a) MIRAMAR THIRD AMENDED, recorded in Plat Book 5, Page 4, of the Public Records of Miami -Dade County, Florida ("Miramar Third Amended Plat"). We have examined the Miramar Third Amended Plat. The Miramar Third Amended Plat only plats the actual lots shown thereon, creates and shows numerous streets and alleys for the use of the public, including the alley to be vacated being the Proposed Closed Right of Way, however, the dedication and other language on the said Plat as found in the Public Records is illegible. (b) AMENDED PLAT OF LES VIOLINS SUBDIVISION, recorded in Plat Book 109, Page 16 of the Public Records of Miami -Dade County, Florida ("Amended Les Violins Plat"). We have examined the Amended Les Violins Plat, the plat that abuts a portion of the Proposed Closed Right of Way. The Amended Les Violins Plat does not include the alley, We have further examined Florida Statutes Section 177.085 which reads as follows: (1) "When any owner of land subdivides the land and dedicates the streets, other roadways, alleys or similar strips on the map or plat, and the dedication contains a provision that the reversionary interest in the street, roadway, alley or other similar strip is reserved unto the dedicator or his or her heirs, successors, assigns, or legal representative, or similar language, and thereafter conveys abutting lots or tracts, the conveyance shall carry the reversionary interest in the abutting street to the centerline or other appropriate boundary, unless the owner clearly provides otherwise in the conveyance." (2) "As to all Plats of subdivided lots heretofore recorded in the Public Records of each county, the holder of any interest in any reversionary rights in streets in such Plats, other than the owner of the abutting lots, shall have 1 year from July 1, 1972, to institute suit in a court of competent jurisdiction in this state to establish or enforce the right, and failure to institute the action within the time shall bar any right, title or interest, and all rights of forfeiture or reversion shall thereupon cease and determine and become unenforceable," 111, The Title Evidence does not disclose any evidence of the institution of an action, or the rendition of a Final Judgment on account thereof, in compliance with Florida Statutes Section 4 M1AMI 1352173.2 7689827917 177,085(2) and provides that upon proper closure and vacation of the proposed Closed Right of Way, fee title to the Proposed Closed Right of Way will belong to Owner. OPINION Based on the presumption that proper and appropriate steps will be taken to close the Proposed Closed Right of Way as above described, it is my opinion that by virtue of the conditions set forth in the Miramar Third Amended Plat, the Statute quoted above and the Title Evidence, the Proposed Closed Right of Way will become the property of the abutting land owners to the centerline on each side of the alley, The Ownership by virtue of the closing of the aforedescribed Proposed Closed Right of Way running through the respective land should place title to the said Proposed Closed Right of Way in the remaining abutting land owners on both sides. Accordingly, title to the Proposed Closed Right of Way should be placed solely in Owner. Therefore, it is my opinion that the following parties must join in the platting of the above described real property in order to grant City of Miami, Florida and the public, a good and proper title to the dedicated areas shown on the final plat of the aforedescribed property, the subdivision thereof to be known as V DOWNTOWN.
