This law firm represents the applicant in relation to the referenced
application for a Major Use Special Permit (MUSP). Thepurpose of this letter is
to request confirmation that the revised plan previously submitted to the Zoning
Department and the Planning Department in relation to the application, dated
received by the Hearing Board 09-17-07, are not a substantial modification to the
previously submitted plans for this project.
The revised plans are substantially unchanged from the original MUSP
plans except for a transfer in density from building 4 to building 1 of 91 units.
The location of the buildings, and their setbacks remain the same. Similarly, the
height of the buildings has not increases and the overall building envelopes and
their footprints remain unchanged. The plans were modified in response to the
City Commission's amendment to the Development Agreement for this
property, Therefore, we respectfully request that you verify that the revisions
are non -substantial based on the criteria described in Section 2215 of the Zoning
Ordinance, This application for a non -substantial modification prior to public
hearing is being made pursuant to Section 2215, 2215.1 and 2215.2 of the Zoning
Ordinance.
