First of all, I would like to clarify my comments on the record; I did not say there were any pending projects
in the Brickell corridor waiting for this ordinance; I said that the west Brickell Area (just like the west Omni
area) could benefit and avail themselves of this ordinance; this comment was based on the fact that the
west Brickell has C-2 and I zoned properties with the 120 foot height limit, and could therefore avail
themselves of this ordinance in exchange for the provision of excess public parking. Also, it was my
recollection that this was continued to the PZ meeting of January — not the first meeting of January. The PZ
meeting is on January 25.
As for the rest of your request, I checked my files for related e-mails. There were some from back in July.
The concept for this ordinance was discussed at a meeting with Ms. Dougherty and then, at my request,
she prepared a draft for our consideration. 4 will forward to you the related e-mails.

This letter is in response to Agenda Item PZ11 which was on the December 14, 2006, City of
Miami Commission Zoning Agenda, regarding the height variance bonus for off street parking.
In that regard, you made specific references to projects in the Brickell Corridor which would
benefit from the proposed ordinance. I would like you to identify in writing those projects and
provide me with access to the reports, studies, City of Miami interdepartmental communications,
letters, documents or other criteria considered or utilized by the Zoning Department or the
Planning Department as the justification for promoting the referenced agenda item before the
commission and at the Planning Board, including the planned implementation of such an

ordinance to approved projects, such as the Bayview Marketplace.
As the attorney for BDB Miami/ Bayview Marketplace stated on the record that she initiated the
proposed height ordinance on behalf of her client, I would also request that you provide me with
access to all documents, whether in writing or in electronic format, received or sent by such
counsel regarding this agenda item, whether in writing or in electronic format.
I believe that all documents and disclosures requested fall within the public domain, and
accordingly, are exempt from any privilege or other non -disclosure.
Because this matter is set before the Commission at its next regular meeting, time is of the
essence in regards to this request and accordingly, I request that the matters requested be made
available to me by 2:00 p.m. this Thursday, December 21, 2006.
