HomeMy WebLinkAboutCC Legislation (Version 3)City of a Legislation Ordinance Hie Nutuber 06-01403zt City Hall 3500 Pan American carve tviiarn, FL 33133 IN\ww.rniamigov.com Final Action Dna: AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAIVII, FLORIDA, RELATING TO PROJECTS LOCATED IN THE URBAN CENTRAL BUSINESS DISTRICT OUTSIDE OF THE DOWNTOWN DR I AREA; PROVIDING FOR A HEIGHT INCREASE FOR THE PROVISION OF PUBLIC PARKING IN EXCESS OF THE REQUIRED OFF STREET PARKING REQUIREMENTS; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS. the City of Miami Planning Advisory Board considered this item at its September 6, 2006 meeting, Rem No, 7 adopted Resolution No. PAB 06-079 and by a vote of six to zero (6-0) has recommended the adoption of this item to the City of Miami City Commission; and WHEREAS, the City Commission, after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its citizens to amend its Zoning Ordinance as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida. is hereby amended by amending the text of said Ordinance as follows: "ARTICLE 4. ZONING DISTRICTS" Sec, 401. Schedule of district regulations. C-2 Liberal Commercial. Intent and Scale: Height: One hundred twenty (120) feet or ten (10) stories, whichever is less, except for broadcasting towers which may be one hundred fifty (150) feet in height (see section 915.3) and except for increase in height permitted (see section 914.3). Sec. 914. Increased development bonus. 914.3 Permissible ten (10) foot height increase for every 75 parking spaces provided to the public in City of Miami Page 1 of 2 Primed On: 10/31/2007 File Number: 06-01403zt excess of the required onsite parking. An increase in height of ten (10) feet shall be permitted for every seventy-five (75) additional Public parking spaces located onsite for any retail project in the Urban Central Business District and outside of the Downtown DRI. Such .parking spaces shall be in addition to those required for the establishment. There shall be a limit of twenty (20) additional feet of height permitted pursuant to this section. The additional public parking spaces to be provided pursuant to this section shall be made available to the qeneraLpubllc during thej g,,ujarbusiness hours of the onsite retail at no cost. The additional public park no spaces shall be made available to major public facilities during after hours at market rates. * *51 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after approval at second reading, unless vetoed by the Mayor within ten days from the date it was passed and adopted. if the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
