HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01380 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING RESOLUTION NO. 07-0626, ADOPTED OCTOBER 25, 2007, IN ITS ENTIRETY, THEREBY CANCELING THE SPECIAL MUNICIPAL ELECTION THAT WAS TO BE HELD IN CONJUNCTION WITH A STATEWIDE ELECTION ON JANUARY 29, 2008, FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY OF MIAMI THE FOLLOWING STRAW BALLOT QUESTION: " WOULD YOU SUPPORT A VOTER PETITION REQUESTING THE BOARD OF MIAMI-DADE COUNTY COMMISSIONERS TO ADOPT AN ORDINANCE THAT WOULD SUBMIT A PROPOSAL TO COUNTY VOTERS TO VOTE ON WHETHER TO AMEND THE COUNTY CHARTER TO PROVIDE FOR THE ELECTION OF THE COUNTY PROPERTY APPRAISER, INSTEAD OF THE COUNTY MAYOR APPOINTING THE COUNTY PROPERTY APPRAISER?;" FURTHER AUTHORIZING AND DIRECTING THE CITY CLERK TO CAUSE A CERTIFIED COPY OF THE HEREIN RESOLUTION TO BE DELIVERED TO THE SUPERVISOR OF ELECTIONS OF MIAMI-DADE COUNTY, FLORIDA. WHEREAS, pursuant to Resolution No. 07-0626, adopted October 25, 2007, the City Commission called for a special municipal election to be held in conjunction with a statewide election, on January 29, 2008, for the purpose of submitting to the qualified electors of the City of Miami a straw ballot question, which would have had no binding or obligatory effect regardless of the voters' approval or disapproval, relating to whether they would support a voter petition requesting the Board of -Miami-Dade County Commissioners to adopt an ordinance that would submit a proposal to County voters to vote on whether to amend the County Charter to provide for the election of the County Property Appraiser, instead of the County Mayor appointing the County Property Appraiser; and WHEREAS, the Miami -Dade County Board of Commissioners on November 6, 2007, adopted a resolution calling for a countywide special election in Miami -Dade County, Florida, to be held on January 29, 2008, for the purpose of submitting to the electors of Miami -Dade County the question of whether the Miami -Dade County Home Rule Charter shall be amended to provide the transfer of the duties of the county property appraiser from a person appointed and supervised by the mayor to a person elected and subject to recall by the voters; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Resolution No. 07-0626, adopted October 25, 2007, is rescinded in its entirety, thereby canceling the special municipal election that was to be held in conjunction with a statewide election on January 29, 2008, for the purpose of submitting to the electors of the City of Miami the following straw City of Miami Page 1 of 2 Printed On: 11/7/2007 File Number: 07-01380 ballot question: " Would you support a voter petition requesting the Board of Miami -Dade County Commissioners to adopt an ordinance that would submit a proposal to county voters to vote on whether to amend the County Charter to provide for the election of the County Property Appraiser, instead of the County Mayor appointing the County Property Appraiser?" Section 3. The City Clerk is authorized and directed to cause a certified copy of this Resolution to be delivered to the Supervisor of Elections of Miami -Dade County. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JOERNANDEZ CIT RNEY Footnotes: {1) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
