HomeMy WebLinkAboutR-07-0661City of Miami Legislation Resolution: R-07-0661 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01383 Final Action Date: 11/9/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH FLORIDA INTERNATIONAL UNIVERSITY ("FIU"), FOR THE STAGING OF THE 2007 FIU FOOTBALL SEASON AT THE ORANGE BOWL STADIUM, TO PROVIDE FOR A WAIVER OF THE TICKET SURCHARGE FOR ALL COMP TICKETS; FURTHER PROVIDING A CREDIT TO FIU AGAINST MONIES DUE TO THE CITY OF MIAMI ("CITY"), IN AN AMOUNT NOT TO EXCEED $10,000, AS THE CITY'S CONTRIBUTION TO SERVICES IN CONNECTION WITH A JOINT CELEBRATION OF THE LAST COLLEGE FOOTBALL GAME AT THE ORANGE BOWL STADIUM IN ORDER TO OFFSET COSTS ASSOCIATED WITH PROVIDING THE COMMUNITY WITH AN OPPORTUNITY TO BE A PART OF THE LAST COLLEGE FOOTBALL GAME AT THE ORANGE BOWL. WHEREAS, on June 14, 2007, the City Commission adopted Resolution No. 07-0327, authorizing the City Manager to execute an agreement with Florida International University ("FIU") for the staging of their 2007 FIU Football Season at the Miami Orange Bowl; and WHEREAS, said agreement authorized the issuance of up to 750 comp tickets subject to the payment of a ticket surcharge; and WHEREAS, FIU has offered Miami -Dade County School Board several comp passes in order to provide an opportunity for local school children to attend the games; and WHEREAS, in an effort to increase interest in its football program, FIU has also offered comp tickets to individuals that buy its 2008 season tickets; and WHEREAS, FIU is requesting that the ticket surcharge be waived on all comp tickets so that it may continue to encourage such programs; and WHEREAS, the City of Miami ("City") benefits from increased attendance at games based on revenues it earns from concessions and parking; and WHEREAS, FIU's December 1st game will be the last college football stadium at the Orange Bowl Stadium; and WHEREAS, FIU has requested the City to partner with it in making the event a community event, allowing a greater number of individuals and families to experience the magic of the Orange Bowl prior to its demolition through the distribution of additional free passes; and WHEREAS, the increased attendance will result in the need to provide additional City services City of Miami Page 1 of 2 File Id: 07-01383 (Version: 2) Printed On: 4/19/2017 File Number: 07-01383 Enactment Number: R-07-0661 such as police, fire and clean-up; and WHEREAS, the City Commission has determined it to be in the best interest of the parties to partner with FIU in providing this co -sponsored community event as a thank you by the City for the community's support throughout the years by providing a credit to FIU against monies due to the City to off -set costs associated with the additional City services; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Amendment to the Agreement, in substantially the attached form, with FIU, a public body corporate, for the staging of the FIU Football Season at the Miami Orange Bowl Stadium, to provide for a waiver of the ticket surcharge on all comp tickets; further providing a credit to FIU against monies due to the City in an amount not to exceed $10,000, as the City's contribution to services in connection with a joint celebration of the last college football game at the Orange Bowl Stadium in order to offset costs associated with providing the community with an opportunity to be a part of the last college football game at the Orange Bowl. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: (1) The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. (2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
