HomeMy WebLinkAboutR-07-0654City of Miami Legislation Resolution: R-07-0654 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01305 Final Action Date: 11/9/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT PARTICIPATION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE MIAMI DOWNTOWN DEVELOPMENT AUTHORITY ("DDA"), FOR THE PAUL S. WALKER MINI PARK PROJECT, CAPITAL IMPROVEMENT PROJECT NO. B-39910D, IN THE TOTAL AMOUNT NOT TO EXCEED $400,000; ALLOCATING FUNDS IN THE AMOUNT OF $250,000, FROM THE DDA, AND FUNDS IN THE AMOUNT OF $150,000, FROM CAPITAL IMPROVEMENT PROJECT B-39910D. WHEREAS, the City of Miami ("City") is committed to creating pocket parks downtown as part of the Department of Park's Master Plan, with the stated goal to provide park space within a quarter -mile of every resident; and WHEREAS, in a deal negotiated with the previous owner, the City reassumed control of the land at 46 West Flagler Street, Miami, Florida, formerly a popular downtown pocket park; and WHEREAS, the City has allocated the amount of $150,000, for the demolition of the existing structure at the location in order to resurrect the Paul S. Walker Mini Park; and WHEREAS, the Downtown Development Authority ("DDA") shares the City's interest in re -constructing the park and supports the City's efforts by providing funding in the amount not to exceed $250,000; and WHEREAS, the 4,200 square foot park will include a new waterfall, walkways, landscaping, seating areas, security lighting, site drainage, metal picket fencing with gate, and signage, for a total not to exceed project budget of $400,000; and WHEREAS, the attached Joint Participation Agreement ("JPA") has been negotiated with the DDA detailing the responsibilities of the parties; and WHEREAS, the DDA funding contribution will be appropriated by a separate Resolution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a JPA, in substantially the attached form, with the DDA, for the Paul S. Walker Mini Park Project, Capital Improvement Project ("CIP") No. B-39910D, in the total amount not to exceed $400,000, with funds allocated in the amount of $250,000, from the DDA, and funds in the amount of $150,000, from CIP B-39910D. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
