CROSLEY ASSISTANT EXECUTIVE DIRECTOR FLORIDA INLAND NAVIGATION DISTRICT September 24, 2007 Mr. Daniel Newhoff Assistant Director Dept. of Conferences, Conventions & Public Facilities City of Miami 400 SE 2nd Ave Miami, FL 33131 RE: Dinner Key Mooring & Anchorage Field Project — Phase I Project #DA-MI-03-79, Project Agreement Extension Dear Mr Newhoff: On September 22, 2007 the District's Board of Commissioners approved your requested time extension to complete your Waterways Assistance Projects). All extensions are for a one (1) year period, ending in September 2008, On or before September 01, 2008, you must submit your final closeout paperwork to complete this project. I am enclosing two originals of a Project Extension Agreement Amendment for your execution. Please read this agreement carefully and execute and return both agreements to me for final execution by the Board. One fully executed original will be returned to you for your records. Sinc ark Crosley 1• Assistant Executive Director ADMINISTRATIVE OFFICE ON THE INTRACOASTAL WATERWAY IN PALM BEACH COUNTY 1314 MARCINSKI ROAD, JUPITER, FLORIDA 33477-9427 TELEPHONE 561-627-3386 FAX No. 561-624-6480 www.aicw.org PROJECT AGREEMENT AMENDMENT In consideration of the continuing mutual promises and covenants contained in that certain PROJECT AGREEMENT No. DA-MI-03-79, Dinner Key Mooring & Anchorage, between the FLORIDA INLAND NAVIGATION DISTRICT (F.I.N.D.) and The City of Miami, hereafter known as the PROJECT SPONSOR. The parties hereby agree that Paragraph 2 of said certain PROJECT AGREEMENT be deleted and the following be substituted therefore: 2. TERM - The PROJECT SPONSOR shall not commence work on the PROJECT prior to the execution of this Agreement unless specifically authorized by the DISTRICT Board. The PROJECT SPONSOR shall complete and submit all required payment reimbursement information on or before September 1, 2008. Pursuant to law in the declaration of a natural disaster, the PROJECT period is extended beyond the original three (3) years from October 1, 2003. This project has been granted an additional one (1) year extension and therefore this PROJECT must be completed by September 30, 2008. Because the completion of the PROJECT has been delayed by a declared natural disaster, the F.I.N.D. Board authorizes an extension of the completion date based upon this delay.
