HomeMy WebLinkAboutR-07-0637City of Miami Legislation Resolution: R-07-0637 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01297 Final Action Date: 11/9/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND COCONUT GROVE CARES, INC., A FLORIDA NON-PROFIT CORPORATION, FOR THE USE OF THE CITY -OWNED PROPERTY LOCATED AT 3870 WASHINGTON AVENUE, MIAMI, FLORIDA, A/K/A 3900 THOMAS AVENUE, ON A MONTH TO MONTH BASIS, FOR THE PURPOSE OF PROVIDING AFTER -SCHOOL INTERVENTION ACTIVITIES FOR AT RISK YOUTH, INCLUDING BUT NOT LIMITED TO ARTS/CRAFTS, CULTURAL, TUTORIAL/EDUCATIONAL, RECREATIONAL/SPORTS ACTIVITIES, PARENTING SKILLS TRAINING AS WELL AS ADMINISTRATIVE OFFICE SPACE; PROVIDING FOR PAYMENT OF AN ANNUAL USE FEE OF ONE HUNDRED DOLLARS ($100), PLUS STATE OF FLORIDA USE TAX, AS APPLICABLE; PROVIDING FOR PAYMENT OF A GUARANTEE DEPOSIT OF FIVE HUNDRED ($500), WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN THE AGREEMENT; AUTHORIZING THE CITY MANAGER TO MAKE NON -SUBSTANTIVE AMENDMENTS TO SAID AGREEMENT AS NEEDED. WHEREAS, the City of Miami ("City") owns the property located at 3870 Washington Avenue, Miami, Florida (a/k/a 3900 Thomas Avenue) ("Property"); and WHEREAS, Coconut Grove Cares, Inc. ("Licensee"), a non-profit corporation, has expressed an interest in using said Property for the purpose of providing after -school intervention activities for at risk youth, including but not limited to arts/crafts, cultural, tutorial/educational, recreational/sports activities, as well as parenting skills training for West (Coconut) Grove residents and related administrative office space; and WHEREAS, the City and Licensee now desire to enter into a Revocable License Agreement ("Agreement") for the purpose of providing said activities to 'at risk' West Grove residents; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, between the City and Licensee, for the use of the Property, on a month to month basis, for the purpose of providing after -school intervention activities for 'at risk' West Grove youth, including but not limited to arts/crafts, cultural, tutorial/educational, recreational/sports activities, parenting skills training as well as related administrative office space. Payment of an annual Use Fee of One Hundred Dollars ($100), plus State of Florida Use Tax, as applicable and payment of a Guarantee Deposit of Five Hundred Dollars ($500), is provided for, with terms and conditions as more particularly described in the Agreement. Section 4. The City Manager is authorized{1} to make non -substantive amendments to the Agreement as needed. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: (1) The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. (2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
