HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01295 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND CONCEPT HOUSE, INC., A FLORIDA NON-PROFIT CORPORATION, FOR THE USE OF THE CITY -OWNED PROPERTY LOCATED AT 4850 NORTHEAST 2ND AVENUE, MIAMI, FLORIDA, ON.A MONTH TO MONTH BASIS, FOR THE PURPOSE OF PROVIDING SUBSTANCE ABUSE TREATMENT AND OUTPATIENT PROGRAM SERVICES, INCLUDING BUT NOT LIMITED TO, INDIVIDUAL AND GROUP COUNSELING, FAMILY THERAPY, LIFE SKILLS TRAINING, SCHOOL DROP -OUT PREVENTION AND RELATED EDUCATIONAL SESSIONS, AS WELL AS RELATED ADMINISTRATIVE OFFICE SPACE; PROVIDING FOR PAYMENT OF AN ANNUAL USE FEE OF ONE HUNDRED DOLLARS ($100), PLUS STATE OF FLORIDA USE TAX, AS APPLICABLE; PROVIDING FOR PAYMENT OF A GUARANTEE DEPOSIT OF FIVE HUNDRED DOLLARS ($500), WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO MAKE NON -SUBSTANTIVE AMENDMENTS TO SAID AGREEMENT AS NEEDED. WHEREAS, the City of Miami ("City") owns the property located at 4850 Northeast 2nd Avenue, Miami, Florida ("Property"); and WHEREAS, Concept House, Inc. ("Licensee"), a Florida non-profit corporation, has expressed an interest in using the Property for the purpose of providing substance abuse treatment and outpatient program services, including but not limited to, individual and group counseling, family therapy, life skills training, school drop -out prevention and related educational sessions for at risk youth, as well as related administrative office space; and WHEREAS, the City and Licensee desire to enter into a Revocable License Agreement ("Agreement")for the purpose of continuing to provide said activities to 'at risk' youth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, between the City and Licensee, for the use of the Property, on a month to month basis, for the purpose of providing substance abuse treatment and outpatient program services, including but not limited to, individual and group counseling, family therapy, life skills training, school drop -out prevention and related educational sessions, as well as related administrative office space., City of Miami Page 1 of 2 Printed On: 10/23/2007 File Number: 07-01295 Section 3. Payment of an Annual Use Fee of One Hundred Dollars ($100), plus State of Florida Use Tax, as applicable and payment of a Guarantee Deposit of Five Hundred Dollars ($500), is provided for, with terms and conditions as more particularly described in the Agreement. Section 4. The City Manager is authorized{1} to make non -substantive amendments to the Agreement as needed. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVE P AS TO FORM AND CORRECTNESS: JO'GE CITY ATTORNEY Footnotes: (1) The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. (2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
