HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hail 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Fite Number: 07-01287 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING A WAIVER FROM CALCULATION OF TOTAL GROSS SALES AND TICKET SURCHARGE, OF THE VALUE OF 3,800 TICKETS SOLD BY THE UNIVERSITY OF MIAMI ("UM") TO FLORIDA INTERNATIONAL UNIVERSITY ("FIU"), FOR THE SEPTEMBER 15, 2007, GAME BETWEEN UM AND FIU, WHICH TICKETS WERE SOLD AT A NOMINAL PRICE FOR USE BY STUDENTS OF FIU. WHEREAS, the City of Miami ("City") and the University of Miami ("UM") entered into an agreement on June 22, 1990 ("Agreement"), for UM's use of the Orange Bowl for the staging of its football games; and WHEREAS, said Agreement provides for UM to pay a Use Fee equal to 10% of the total gross actual ticket sales actually received by UM, less any applicable taxes and less the ticket surcharge to the admission price; and WHEREAS, the Agreement addresses the issuance of complimentary tickets but does not address the payment of the ticket surcharge and percentage of gross ticket sales on discounted tickets; and WHEREAS, UM sold Florida International University ("FIU") 2500 tickets at $1, per ticket and 1300 tickets at $10, per ticket; and WHEREAS, given the location of these tickets, 800 of these tickets would have sold for $47, each and 3000 would have sold for $20, each; and WHEREAS, UM has requested that the value of the 3800 tickets be excluded from the calculation of the Use Fee and ticket surcharge; and WHEREAS, the City has determined it to be in the best interest of the parties to grant this request; NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The waiver from calculation of the total gross sales and ticket surcharge, of the value of the 3800 tickets sold by the University of Miami to Florida International University, for the September 15, 2007 game between UM and FIU, which tickets were sold at a nominal price for use by students of FIU, is authorized. Section 3.
