HomeMy WebLinkAboutR-07-0619City of Miami Legislation Resolution: R-07-0619 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01055ac Final Action Date: 10/25/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION WITH ATTACHMENT(S) CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE AN ALLEY LOCATED ALONG THE SOUTH SIDE OF NORTHEAST 18TH STREET BETWEEN NORTHEAST 4TH AVENUE AND NORTH BAYSHORE DRIVE, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board, at its meeting on September 24, 2007, Item No. 3, following an advertised public hearing, adopted Resolution No. ZB 07-0082 by a vote of seven to two (7-2) vote, recommending APPROVAL of closing, vacating, abandoning, and discontinuing (a portion of) a public right-of-way as set forth; and WHEREAS, the Department of Public Works and the Plat and Street Committee have studied the subject vacation and closure and determined that it will not affect pedestrian or vehicular traffic circulation or access for public service; and WHEREAS, the Plat and Street Committee has reviewed the subject tentative plat and determined that all technical requirements have been met; and WHEREAS, the City Commission, finds that it is in the best interest of the general welfare of the City of Miami and its inhabitants to grant the vacation and closure of a portion of the public right-of-way as hereinafter described, and deems it advisable to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Therefore, the portion of a street/an alley located along the South side of Northeast 18th Street between Northeast 4th Avenue, and North Bayshore Drive, Miami, Florida, more particularly described in Exhibit "A," is closed, vacated, abandoned and discontinued for public use. Section 3. The Applicant additionally made the following voluntary proffers: a) $20,000.00 for on -site trees to be planted in Margaret Pace Park; b) $5,000.00 for bicycle racks at Margaret Pace Park, for a total proffer of $25,000.00. Such proffers will be paid prior to the issuance of a Certificate of Occupancy for the building adjacent to the portion of the alley being closed; c) Additionally, Applicant will provide office space, to be made available at no charge, in the lobby of the building for the municipal park ranger for Margaret Pace Park. Section 4. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
