HomeMy WebLinkAboutR-07-0615City of Miami Legislation Resolution: R-07-0615 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00047xc Final Action Date: 10/25/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION WITH ATTACHMENT(S) APPROVING A SPECIAL EXCEPTION, REQUIRING CITY COMMISSION APPROVAL, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 6, SECTION 612, SD-12 BUFFER OVERLAY DISTRICT, TO ALLOW SURFACE PARKING IN THE SD-12 ZONING TO SERVE THE ABUTTING COMMERCIAL DISTRICT, WITH A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED SUBJECT TO THE FOLLOWING CONDITION: A COMPLETE LANDSCAPE PLAN, WITH SPECIFICATIONS, DEPICTING IRRIGATION AND ILLUMINATION FOR THE PARKING AREA MUST BE SUBMITTED FOR REVIEW AND APPROVAL BY THE PLANNING DEPARTMENT PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 2721 AND 2735 COCONUT AVENUE, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board, at its meeting on September 24, 2007, Item No. 7, following an advertised public hearing, adopted Resolution No. ZB 07-0085 by a vote of eight to zero (8-0) vote, recommending APPROVAL of a Special Exception requiring City Commission approval as set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the decision of the Zoning Board, finds the application for the Special Exception meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to reverse the decision of the Zoning Board and grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The decision of the Zoning Board to approve the Special Exception as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 6, Section 612, SD-12 Buffer Overlay District, to allow surface parking in the SD-12 Zoning for the property(ies) located at approximately 2721 and 2735 Coconut Avenue, Miami, Florida, legally described in attached "Exhibit A," pursuant to plans on file and subject to a time limitation of twelve (12) months in which a building permit must be obtained, subject to the following Planning Department condition: a complete landscape plan, with specifications, depicting irrigation and illumination for the parking area City of Miami Page 1 of 6 File Id: 07-00047xc (Version: 3) Printed On: 4/18/2017 File Number: 07-00047xc Enactment Number: R-07-0615 must be submitted for review and approval by the Planning Department prior to the issuance of any building permits and the Special Exception granted. Section 3. The findings of fact set forth below are made with respect to the subject property: a. These findings have been made by the City Commission to approve this project with conditions. Section 4. The granting of this special exception is conditioned upon the approval of a new landscape plan by the Planning Department, to include irrigation and illumination, including but not limited to dense landscaping along the western boundary next to the apartment buildings. Moreover, in addition, the Applicant will use its best efforts to reduce intrusive illumination into neighboring residential areas. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
