Fernal},yl'jle2, ity orney „ DATE: October 16, 2/007 RE: City Commission eeting — October 25, 2007 Proposed Resolution of the Miami City Commission authorizing the expenditure of attorney's fees and costs, in an amount approved by the City Attorney, for the continued engagement of the Law Offices of Robert S. Glazier in connection with appellate proceedings arising from the cases of Sidney S. Wellman, et al. vs. City of Miami, Case No. 99-19523 CA 15, Nadine Theodore vs. City of Miami, Case No. 99-28417 CA 15, State vs. Jose A. Juarez, Case No. F99-028701, and State vs. Christino Nieves, Case No. F00-30698. (File No. 07-01273) The attached legislation has been prepared for placement on the October 25, 2007, City Commission Agenda. The resolution authorizes the expenditure of attorney's fees and costs, in an amount approved by the City Attorney, for the for the continued engagement of the Law Offices of Robert S. Glazier in connection with appellate proceedings arising from the cases of Sidney S. Wellman, et al. vs. City of Miami, Case No. 99-19523 CA 15, Nadine Theodore vs. City of Miami, Case No. 99-28417 CA 15, State vs. Jose A. Juarez, Case No. F99-028701, and State vs. Christino Nieves, Case No. F00-30698. As you may recall, this matters involve the class action challenge to the City's Vehicle Impoundment (VIP) Ordinance. Currently, the City is on appeal in all four cases on remand from the Florida Supreme Court litigating the issue of whether the VIP Ordinance is constitutional.
