Purpose of Item: A Resolution of the Miami City Commission, with attachment (s), authorizing the City Manager to execute an Agreement, in substantially the attached form, with the Florida Department of Environmental Protection ("DEP") in order to reinstate and amend DEP Agreement Number CZ613, as more particularly described in Exhibit B, attached hereto and made part hereof, for the baywaik design of the public boat ramp located on Watson Island, to extend the completion and reimbursement date of the project. to May 31 , 2008 . Directo City Manager Paee 1 of 2 Subject: Grant Agreement Amendment No. 2 between the Florida Department of Environmental Protection and the City of Miami for the Watson Island Boat Ramp Project. Background Information: The City and the Department of Off Street Parking ("DOSP"), entered into an Agreement ("Agreement") on August 8, 2002 to design, construct, finance, operate, maintain and manage the Boat Ramp Parking Facility in the City of Miami at Watson Island. While the City has leveraged substantial funding from other grant sources for coastal stabilization features along the southern shoreline, the City needs additional monies to curb soil erosion, provide shoreline protection as well as public seating facilities along the baywalk area earmarked for this southern shoreline. Currently, approximately 500 linear feet along the southeastern shoreline of Watson Island has no shoreline protective features for its surface soil. The City received a grant from the Department of Environmental Protection ("DEP") in the amount of $50,000 with a local match of an equal amount being funded by the DOSP to aid in funding the construction of the retaining wall/public seating for the baywalk. The term to use the monies for the construction expired on March 31, 2007. The Department of Environmental Resource Management ("DERM") had requested the City undertake a clean-up of the property to remove all shoreline exotic vegetation in order to better determine the location of the mean high water line. The City completed the removal of exotics and resubmitted the design to DERM for their review. Upon subsequent meetings with DERM, the City was informed the plans, as submitted, would not be approved and an overall redesign of the baywalk had to be undertaken. Due to this delay, the City was in jeopardy of losing the funding provided by DEP as construction could not be completed by March 31, 2007. Due to the requirements imposed by DERM, the City went back to DEP in an attempt to obtain approval by the grantor to allow a change in the scope of work and allow the funds to be used for the design of the project. In addition, the term of the grant award was extended to allow the City additional time to complete the redesign of the project. The final design, which takes into account all of the DERM requirements, was submitted to DERM in late August 2007. DEP decided to extend the grant until May 31, 2008 in order to allow the City sufficient time to obtain DERM approvals and to submit any additional reimbursement requests.
