Subject: Supplemental Agreement No. 1 between the City of Miami and the Federal Aviation
Department (FAA) for the use of a VORTAC Site at Virginia Key, Miami, Florida.
Purpose of Item:
A Resolution of the City of Miami Commission, authorizing the City Manager to execute a
Supplemental Agreement ("Agreement"), in substantially the attached form, with the United States of
America acting by and through the Department of Transportation Federal Aviation Administration
(FAA) ("Lessee"), a federal agency, for the use of approximately 1.3774 acres or 60,000 square feet
on Virginia Key ("Property"), for use as a Very High Frequency Omni -directional Range and Tactical
Air Navigational (VORTAC) facility, to provide for the reinstatement of the Agreement and extension
of same for a maximum of four (4) one-year terms, commencing October 1, 2004, with a rent of
$17,832.36 yearly or $1,486.03 monthly; with other terms and conditions more particularly set forth
in the Agreement.

Subject: Supplemental Agreement No. 1 between the City of Miami and the Federal Aviation
Department (FAA) for the use of a VORTAC Site at Virginia Key, Miami, Florida.
Background Information:
This Supplemental Agreement will extend a Lease Agreement with the FAA retroactive from October 1,
2004 to September 30, 2008 for a maximum of four additional one-year terms. The Supplemental
Agreement will allow the City additional time to complete the Virginia Key Master Plan and to review
the appropriateness of future lease extensions for this VORTAC facility and rent.
A similar Supplemental Agreement was brought before the City Commission in March 2005 but was
deferred pending resolution of the environmental study related to noise being undertaken by the Noise
Abatement Task Force. The recommendations of the Task Force were ultimately accepted by the
Federal Aviation Administration in a Finding of No Significant Impact issued on May 24, 2006.
According to the Miami -Dade Aviation Department, most of the recommendations have since been
implemented by the FAA Miami Air Traffic Control Tower. The main changes that resulted from the
implementation is a decrease in the number of flights over the residential areas located east of the Miami
International Airport with aircraft being directed to the greatest extent possible west of the airport, over
industrial areas.
