HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution File Number: 07-01198 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE SUPPLEMENTAL AGREEMENT NO. 1 ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("LESSOR") AND THE UNITED STATES OF AMERICA, ACTING BY AND THROUGH THE DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION, SOUTHERN REGION, ATLANTA GEORGIA, ("FAA") A FEDERAL AGENCY, FOR THE USE OF APPROXIMATELY 1.3774 ACRES OR 60,000 SQUARE FEET ON VIRGINIA KEY (THE "PROPERTY'), FOR USE AS A VERY HIGH FREQUENCY OMNI-DIRECTIONAL RANGE AND TACTICAL AIR NAVIGATIONAL ("VORTAC") FACILITY, TO PROVIDE FOR THE REINSTATEMENT OF FAA LEASE NO. DTFA06-94-L-13026 FACILITY :VORTAC DATED JUNE 3, 1994 (THE "ORIGINAL LEASE") AND EXTENSION OF SAME FOR A MAXIMUM OF FOUR (4) ONE-YEAR TERMS, COMMENCING OCTOBER 1, 2004, WITH A RENT OF $17,832.36 YEARLY OR $1,486.03 MONTHLY, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID AGREEMENT. 11 WHEREAS, the City of Miami ("Lessor") is the owner of certain real property located on Virginia Key, Miami Florida, which has been occupied by Department of Transportation Federal Aviation Administration ("FAA") since 1994; and WHEREAS, Lessor has agreed to continue to lease said property to the FAA consistent with the terms and conditions set forth herein; and WHEREAS, it is the desire of the parties to extend FAA Lease No. DTFA06-94-L-13026, Facility: Vortac, dated June 3, 1994 (the "Original Lease"), whereby the FAA leased 1.3774 acres or 60,000 square feet covering the Very High Frequency Omni -directional Range and Tactical Air Navigation ("VORTAC") site on Virginia Key, Miami, Florida ("Property"); and WHEREAS, a lease provided to another government entity is exempt from the requirements of Section 29-B of the Miami City Charter; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute Supplemental Agreement No. 1 ("Agreement"), in substantially the attached form, between the Lessor and the FAA, a federal agency, for the use of the Property, for use as a VORTAC facility, to provide for the reinstatement of the City of Miami Page 1 of 2 Printed On: 10/2/2007 File Number: 07-01198 Original Lease and extension of same for a maximum of four (4) one-year terms, commencing October 1, 2004, with a rent of $17,832.36 yearly or $1,486.03 monthly, with terms and conditions as more particularly set forth in said Agreement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. FERNANDEZ CITY ATTORNEY Footnotes: {1}The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code: provisions. {2}If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was Passed and adopted.
