Subject: State of Florida, Board of Trustees for Internal Improvement Fund ("State") Lease Renewal For
Lummus Park located at 176 and 250 NW North River Drive, Miami, Florida.
Purpose of Item:
A Resolution of the City Commission, authorizing the City Manager to execute a Lease Renewal
("Lease Renewal"), in substantially the attached form, between the City of Miami ("City") and the
State of Florida Board of Trustees for Internal Improvement Fund ("State"), for the use of
approximately 39,000 square feet of state-owned submerged lands ("Submerged Lands") located
adjacent to city -owned uplands at 176 and 250 NW North River Drive, Miami, Florida ("Uplands").
The Lease Renewal provides for: 1) a term of approximately five (5) years, commencing November
20, 2007 and expiring December 31, 2012, to facilitate the City's construction and maintenance of
public docks on the Miami River for Lummus Park; 2) correcting the legal description of the
preceding lease renewal commencing January 27, 2003, due to a scrivener's error; 3) providing for
payment of a state lease processing fee of $512.00 and allocating funds from General Fund
Account No. 04002.221100.544000.0000.00000; and 4) further authorizing the City Manager to maim'
non -substantive or non -material amendments and to execute subsequent lease renewals for said
purpose, with terms and conditions more partic_ilarly set forth in the Lease Renewal.

Subject: State of Florida, Board of Trustees for Internal Improvement Fund ("State") Lease Renewal
For Lummus Park located at 176 and 250 NW North River Drive, Miami, Florida.
Background Information:
The City of Miami ("City") entered into a Lease dated January 1, 2002 with the State of Florida, Board
of Trustees for Internal Improvement Fund ("State") and entered into a subsequent lease renewal dated
January' 27, 2003 for the City's use of state-owned Submerged Lands located adjacent to the city's
uplands at 176 and 250 NW North River Drive, Miami, Florida. The City has eannarked these state-
owned submerged lands for the future construction and maintenance of public docks which will serve as
an amenity to the nearby Lummus Park. As required by the Florida Department of Environmental
Protection, the state agency directly administering this lease, the City recently obtained an extension to
the DEP Permit so as to remain compliant with the DEP permitting necessary to facilitate the City's
future plans for dock construction at this site. Due to a scrivener's error in the legal description
referenced in the recitals section of the January 27, 2003 Lease Renewal, it is also necessary to correct
this substantive error.
