HomeMy WebLinkAboutR-07-0549City of Miami Legislation Resolution: R-07-0549 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-01433xc Final Action Date: 9/27/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING A SPECIAL EXCEPTION, REQUIRING CITY COMMISSION APPROVAL, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, SUPPLEMENT 14, TO ALLOW PARKING ON R-3 PROPERTIES WITH SD-12 OVERLAY TO SERVE ADJACENT COMMERCIAL USES, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 6443 BISCAYNE BOULEVARD, 621-625 AND 645 NORTHEAST 64TH TERRACE, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board at its meeting on November 13, 2006, Item No. Z.7, following an advertised public hearing, adopted Resolution No. ZB 06-1257 by a vote of six to one (6-1), RECOMMENDING APPROVAL of a special exception requiring City Commission approval as hereinafter set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and WHEREAS, it is found and determined that the design review criteria listed in §1305.2 of the Zoning Ordinance, which is deemed as being incorporated by reference herein, as applicable, has been met; and WHEREAS, the City Commission after careful consideration of this matter, and considering the decision of the Zoning Board, finds the application for the Special Exception meets the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the decision of the Zoning Board and grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The decision of the Zoning Board to recommend approval of a Special Exception, requiring City Commission approval as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, Schedule of District Regulations, to allow parking on "R-3" properties with "SD-12" overlay to serve adjacent commercial uses for the properties located at approximately 6443 Biscayne Boulevard, 621-625 and 645 Northeast 64th Terrace, Miami, Florida, more particularly described in "Exhibit A," attached and incorporated, is affirmed and the Special Exception granted. In granting this Special Exception, the City Commission adds the following additional conditions and safeguards: 1) After 8:00 PM the Applicant shall make atleast seventy five (75) parking spaces available for lease or open to the public through a ticket parking system at market rate as the spaces become available from the office users; 2) On NE 64th Terrace along the frontage of the C-1 zoned property (6443 Biscayne Blvd.), approximately 67 feet East of Biscayne Boulevard shall be converted and constructed by the property owner to a two-way street prior to obtaining the certificate of occupancy per this Resolution. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1 } Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
