Fernandez, C� DATE: September 18, 200 RE: Proposed Resolution; Septe ber 27, 2007, City Commission Meeting Authorizing the engagement of outside counsel to represent the City of Miami's creation of the Coconut Grove Business Improvement District as a special taxing district within the City of Miami (Matter# A-05004625 (File No. 07-01187) 4 f This Resolution seeks authorization to engage David E. Cardwell, Esquire, and The Cardwell Law Firm for the purpose of representing the City of Miami's creation of the Coconut Grove Business Improvement District as a special taxing district within the City of Miami (the "City"), with funding in an amount not to exceed $10,000, to be appropriated from the 2007-2008 Budget of the Coconut Grove Business Improvement Committee (the "BIC"). Background The City established, approved and created the BIC pursuant to Ordinance No. 12564, adopted July 22, 2004. The BIC serves as an instrument of advice and makes recommendations to the City Commission regarding, but not limited to (a) coordination, funding and implementation of all infrastructure improvements, maintenance and other projects in specific areas of Coconut Grove; (b) appropriate expenditures from the Coconut Grove Business District Improvement Trust Fund; (c) segregation, designation, and use of parking surcharge infrastructure proceeds from parking facilities located within the jurisdiction of the BIC; (d) the use of certain funds to be matched for marketing and special events in the Coconut Grove Special Events District; and (e) review, approval or rejection of applications for special events in the Coconut Grove Special Events District, and appropriate expenditures from the Coconut Grove Special Events District Fund. Since the Spring of 2005, the BIC has been studying and considering the potential creation of the Coconut Grove Business Improvement District as a special taxing district within Coconut Grove to undertake additional improvements, maintenance, marketing, and other services, the potential boundaries of such a district, the potential. types and varieties of services, and the potential methods of assessments and other sources of funding. The BIC at its September 6, 2007 budget meeting approved and has recommended and requested the City Commission to approve at the City Commission's A-0500462 RJJ September 27th meeting the 2007-2008 BIC Budget, which includes an amount not to exceed $10,000, for the retention of an outside counsel to assist with the creation of the 'coconut Grove Business Improvement District. It would thus be appropriate for the City Commission to authorize the engagement of outside counsel for the creation of the special taxing district. cc: Pedro Hernandez, City Manager Priscilla A.
