("ABDA"), AN EXTENSION OF TIME, UNTIL MARCH 30, 2008, TO COMMENCE CONSTRUCTION ON THE PROPERTIES LOCATED AT 790 NORTHWEST 29TH TERRACE, 3255 NORTHWEST 11TH COURT, 3245 NORTHWEST 11TH COURT AND 1264 NORTHWEST 31ST STREET, MIAMI, FLORIDA, LEGALLY DESCRIBED ON EXHIBIT "A," ATTACHED AND INCORPORATED (COLLECTIVELY, THE "PROPERTIES;" INDIVIDUALLY, A "PROPERTY"), AND AN EXTENSION UNTIL DECEMBER 31, 2008, TO COMPLETE CONSTRUCTION OF A TWIN HOME ON EACH SUCH PROPERTY; AUTHORIZING THE CONSTRUCTION OF A TWIN HOME, RATHER THAN A SINGLE FAMILY HOME, ON THE PROPERTY LOCATED AT 790 NORTHWEST 29TH TERRACE, MIAMI, FLORIDA; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR SAID PURPOSES. WHEREAS, pursuant to Resolution No. 03-215, adopted February 27, 2003, the City Commission approved the conveyance of two City of Miami ("City") owned vacant parcels located at 2374 Northwest 33rd Street and 790 Northwest 29th Terrace, Miami, Florida, to Allapattah Business Development Authority, Inc. ("ABDA"), a Florida not -for -profit corporation, for the development of two new single family homes for low and moderate -income families and individuals; and WHEREAS, pursuant to Resolution No. 04-0289, adopted May 6, 2004, the City Commission designated certain City -owned Properties located at 3255 Northwest 11th Court, 3245 Northwest 11th Court, and 1264 Northwest 31 st Street, Miami, Florida, as surplus, and authorized ABDA to develop three (3) twin homes for affordable to very low, low and/or moderate -income families and/or individuals; and WHEREAS, ABDA has completed one single family house located at 2374 Northwest 33rd Street, Miami, Florida; and WHEREAS, the lot located at 790 Northwest 29th Terrace, Miami, Florida, has sufficient square footage to construct a twin home; and WHEREAS, due to previous delays in obtaining building permits from the City and procuring a contractor, ABDA is requesting extensions of time to commence and complete construction on the Properties listed on Exhibit "A," attached and incorporated; and WHEREAS, ABDA has obtained the required permits and is in the process of selecting a contractor; and WHEREAS, the Administration recommends granting ABDA an extension of time until March 30, 2008, to commence construction on the Properties specified on Exhibit "A," and until December 31, City of Miami Page 1 of 2 Printed On: 8/29/2007 File Number: 07-01057 2008, to complete construction of a twin home on each such Property; and WHEREAS, the Administration also recommends authorizing the construction of a twin home, rather than a single family home, on the Property located at 790 Northwest 29th Terrace, Miami, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. ABDA is granted an extension of time until March 30, 2008, to commence construction on the Properties specified on Exhibit "A," attached and incorporated, and an extension until December 31, 2008, to complete construction of a twin home on each such Property. Section 3. The construction of a twin home, rather than a single family home, on the Property located at 790 Northwest 29th Terrace, Miami, Florida, is authorized. Section 4. It is the intention of the Miami City Commission that title to the Properties described above and on Exhibit "A," shall be deemed to have remained in ABDA from the date of conveyance. Section 5. The City Manager is authorized{1} to execute to execute all necessary documents for said purposes. Section 6. This Resolution shall become effective irnmediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. rrimmorr CITNFY �b Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
