HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-01056 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE TRANSFER OF 33RD PROGRAM YEAR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS, IN THE TOTAL AMOUNT OF $75,100, FROM THE CITY OF MIAMI DEPARTMENT OF COMMUNITY DEVELOPMENT'S PUBLIC SERVICES RESERVE FOR DISTRICT 2; ALLOCATING SAID FUNDS TO DE HOSTOS SENIOR CENTER, INC., FOR PUBLIC SERVICES, TO PROVIDE CONGREGATE AND HOMEBOUND MEALS TO THE ELDERLY RESIDENTS IN DISTRICT 2; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH SAID AGENCY, FOR SAID PURPOSE. WHEREAS, De Hostos Senior Center, Inc. ("De Hostos") is a not -for -profit agency that provides congregate and home -bound meals to approximately sixty (60) elderly residents in District 2; and WHEREAS, in April, 2007, the Department of Community Development ("Department") contracted the services of Sanson, Kline, Jacomino & Company ("Accounting Firm"), an outside accounting firm, to review the finances of De Hostos and assist the Department in determining whether the amounts reported by De Hostos as expenditures during July 1, 2005 through January 31, 2007, were valid; and WHEREAS, pursuant to Resolution No. 07-0314, adopted June 12, 2007, the City Commission authorized the allocation of 33rd Program Year Community Development Block Grant ("CDBG") funds, in the amount of $75,100, to the Public Services Reserve for District 2; and WHEREAS, the Department did not recommend De Hostos for 33rd Year funding at the June 12, 2007, City Commission meeting because the Accounting Firm had not released the Independent Accountants' Report on Applying Agreed -Upon Procedures ("the report"); and WHEREAS, on June 29, 2007, the Report revealed accounting inconsistencies; and WHEREAS, De Hostos worked with the Department and the accounting firm to correct identified inconsistencies and implement procedures to prevent future accounting errors; and WHEREAS, the Department deemed the implemented procedures to prevent future accounting inconsistencies acceptable; and WHEREAS, the Administration is recommending the transfer of funds, in the amount of $75,100, from the Department's Public Services Reserve for District 2, and the allocation of said funds to De Hostos, for the provision of congregate and home -bound meals to elderly residents in District 2, in the 33rd program year; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 Printed On: 8/28/2007 File Number: 07-01056 Section 1. The recitals contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of 33rd Program Year CDBG funds, in the amount of $75,100, from the Department's Public Services Reserve for District 2, and the allocation of said funds to De Hostos, for the provision of congregate and home -bound meals to elderly residents in District 2, is authorized. Section 3. The City Manager is authorized {1} to execute an Agreement, in substantially the attached form, with said agency, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. CITY ATT Footnotes: NDEZ�� {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
