Purpose of Item:
A Resolution of the Miami City Commission, authorizing the City Manager to execute a Revocable
License Agreement ("Agreement"), in substantially the attached form between the City of Miami and
Miami -Dade County Health Department, Florida Department of Health, an executive agency of the
State of Florida ("Licensee") for the use of a certain area located at 1380 NW 6th Street, Lot# E2,
Miami, FL. ("Area") within the Orange Bowl Stadium Parking ("Property"), for use as parking for up
to 100 non-commercial, employee vehicles, on a month -to -month basis, effective October 1, 2007 and
providing for payment of a Monthly Use Fee of Five Thousand Two Hundred Dollars ($5,200.00),
plus State of Florida Use Tax, as applicable; further authorizing the City Manager to make non -
substantive amendments to the Agreement, with terms and conditions more particularly described in
said Agreement.

Background Information:
Miami -Dade County Health Department, Florida Department of Health ("Licensee") is in the process of
constructing an expanded, administrative facility at 1350 NW 14`h Avenue, Miami, FL. During this
construction phase, a portion of the Licensee's existing parking lot will be used for storage of
construction materials, thereby temporarily displacing its non-commercial employee parking. To
accommodate non-commercial, employee parking during this three-year construction period, the
Licensee is requesting that the City allow it to license out a portion of the City's Orange Bowl Stadium
Parking. The Licensee acknowledges and accepts that a necessary condition to this License that the City
reserves the right to request the Licensee to make alternative parking arrangements during scheduled
game events and other events scheduled at the Orange Bowl. In instances such as these, the City will
accordingly make prorated adjustments to the Licensee's monthly Use Fee.
The City Administration will charge the Licensee a rate comparable to that being charged in the vicinity
by Miami Parking Authority, that is, $2.60 per parking space per day for 20 days a month, with a 3%
annual escalator. As additional consideration, the Licensee has agreed to provide up to four health fairs
annually for the benefit of City of Miami employees at a few city-wide locations.
