A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE
AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM,
BETWEEN THE CITY OF MIAMI ("CITY") AND MIAMI-DADE COUNTY HEALTH
DEPARTMENT, FLORIDA DEPARTMENT OF HEALTH, AN EXECUTIVE AGENCY
OF THE STATE OF FLORIDA, FOR THE USE OF A CERTAIN AREA WITHIN THE
CITY -OWNED ORANGE BOWL PROPERTY, LOCATED AT 1380 NORTHWEST
6TH STREET, LOT #E2, MIAMI, FLORIDA, FOR USE AS PARKING FOR UP TO
ONE HUNDRED (100) NON-COMMERCIAL, EMPLOYEE VEHICLES, ON A MONTH
TO MONTH BASIS, EFFECTIVE OCTOBER 1, 2007; PROVIDING FOR THE
PAYMENT OF A MONTHLY USE FEE OF FIVE THOUSAND TWO HUNDRED
DOLLARS ($5,200); FURTHER AUTHORIZING THE CITY MANAGER TO MAKE
NON -SUBSTANTIVE AMENDMENTS TO SAID AGREEMENT, WITH TERMS AND
CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID AGREEMENT.
WHEREAS, the City of Miami ("City") is the owner of a certain area located at 1380 Northwest
6th Street, Lot #E2, Miami, Florida ("Area") located within the Orange Bowl Stadium Parking
("Property"); and
WHEREAS, Miami -Dade County Health Department, Florida Department of Health, an executive
agency of the State of Florida ("Licensee") requested the use of One Hundred (100) parking spaces
at the City's Property to temporarily accommodate Licensee's employee parking needs during the
estimated three year construction of their expanded administrative facility at 1350 Northwest 14th
Avenue, Miami, Florida; and
WHEREAS, the Licensee agrees to modifying its usage of Orange Bowl Stadium Parking to
accommodate the existing primary stadium user and any potential primary stadium users; and
WHEREAS, the City and the Licensee now desire to enter into a Revocable License Agreement
("Agreement") to accommodate the Licensee's need for non-commercial, employee parking;
NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the
attached form, between the City and the Licensee, for the use of the Area located within the Property,
for use as parking for up to one hundred (100) non-commercial, employee vehicles, on a month to

month basis, effective October 1, 2007, with said agreement providing for the Licensee's payment of
a monthly use fee of Five Thousand Two Hundred Dollars ($5,200).
Section 3. The City Manager is further authorized{1} to make non -substantive amendments to
said Agreement, with terms and conditions as more particularly set forth in said Agreement.
Section 4. This Resolution shall be effective immediately upon its adoption and signature of the
Mayor.{2}
Footnotes:
(1) The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
(2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
