Subject: Authorizing City Code Amendment to Establish Marina Capital Improvement Fund
Purpose of Item:
The administration recommends the City Commission adopt the attached Ordinance amending
Chapter 50, Article V, Division 4. of the Code of the City of Miami, Florida, as amended, entitled
"City Marinas — Rates, Charges, Billing, and Collection" by adding a new section to provide for a
sustained funding source for marinas capital repairs and capital related improvements to be
appropriated from annual dockage revenues collected by the City to be deposited in a special revenue
account in an amount not to exceed ten percent of gross annual dockage revenues; containing a
severability clause; a repealer provision and providing for an effective date.

Subject: Authorizing City Code Amendment to Establish Marina Capital Improvement Fund
Background Information:
Marinas are an integral part of our community, serving as stewards of the environment and providing
safe, family -friendly gateways to boating and water based recreational and commercial activities. The
City's marinas provide the vital infrastructure, facilities, and equipment necessary to facilitate both
commercial and recreational opportunities for over one thousand city marina customers while providing
a positive economic impact to our community.
Recently the City was informed by the Florida Inland Navigation District (FIND) that our current
marinas dockage rate structure which provides a 30% dockage rate discount for City residents is in
violation of the District's rules for grant funding eligibility. FIND is a state created municipal grant
funding agency that, over the past several years, has awarded the City approximately $4 million in
funding for marine capital projects, including the Bicentennial Park Sea Wall reconstruction, derelict
vessel removal, and the Dinner Key Mooring Field. FIND Rules 66B-2.003(25) and 2.004(4) prohibit
municipal marinas from charging dissimilar fees to various users within the FIND district. This has
placed the City's recent grant application to FIND of $440,000 in jeopardy, and may adversely impact
other previously awarded grants to the City, along with future grant opportunities from the District. For
this reason, we have adjusted the marina rates, effective October 1, 2007, to eliminate the current
disparity placing the City in violation of FIND funding eligibility and provided similar adjustments to
dockage rates for short term, transient and sight seeing vessels. Additionally, the increases will better
align our dockage rates to our regional market (the City's rates were last increased in 2003), and provide
additional recurring revenues to our General Fund. These rate increases are projected to provide the City
with $2,135,500 in additional annual revenues increasing our total annual revenues to over $8 million.
Currently there is no dedicated or sustained funding source to provide for the proper repair, upkeep and
improvement of our marina facilities which is vital to the City's ability to safely operate and maintain
same in first-class condition. Additionally,there is no dedicated source of grant funding match for
worthwhile facility improvements at City marinas. Therefore, we are recommending that ten percent
(l 0%) of the gross dockage monies received each fiscal year be set aside into a special account that shall
be dedicated to funding necessary capital repairs and capital related improvements to city marinas and
mooring facilities and for the provision of matching funds for grant opportunities in order to continue to
provide for the public safety and welfare of our marina customers and maintenance of these facilities in
first-class condition.
