HomeMy WebLinkAboutLegislation FR/SRCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.mlamigov.com File Number: 07-00573 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 50/ARTICLE VI DIVISION 4 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "SHIPS, VESSELS, AND WATERWAYS/CITY MARINAS/ RATES, CHARGES, BILLING, AND COLLECTION," BY ADDING A NEW SECTION TO PROVIDE FOR A SUSTAINED FUNDING SOURCE FOR MARINAS' CAPITAL REPAIRS AND CAPITAL RELATED IMPROVEMENTS, TO BE APPROPRIATED FROM ANNUAL DOCKAGE REVENUES COLLECTED BY THE CITY OF MIAMI TO BE DEPOSITED IN A SPECIAL REVENUE ACCOUNT, IN AN AMOUNT NOT TO EXCEED TEN PERCENT OF GROSS ANNUAL DOCKAGE REVENUES; CONTAINING A SEVERABILITY CLAUSE; A REPEALER PROVISION AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami City Commission recognizes that our City marinas serve as stewards of the environment and safe, family -friendly gateways to boating and water based recreational and commercial activities, and WHEREAS, our City marinas provide the vital infrastructure, facilities, and equipment necessary to facilitate these commercial and recreational opportunities for over one thousand City marina customers while. providing a positive economic impact to our community, and WHEREAS, the proper repair, upkeep, and improvement to these facilities is vital to the City's ability to safely operate and maintain same in first-class condition; and WHEREAS, currently there is no dedicated or sustained funding source to provide for these necessary functions, nor is there a dedicated source of grant funding match for worthwhile facility capital improvements at City marinas; WHEREAS, the Miami City Commission, after careful consideration of this matter, deems It advisable and necessary for the best interests of the citizens of Miami to create a dedicated, sustained source of funding for capital repair and improvement projects, and as a source of funding for federal, state, and other agency grant applications, in order to continue to provide for the public safety and welfare of our marina customers and maintenance of these facilities in first-class condition; h. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 50/Article V/Division 4 of the Code of the City of Miami, Florida, as amended, entitled: "Ships, Vessels, and Waterways/City Marinas/Rates, Charges, Billing, and Collection," is amended in.the following particulars: {1} City of Miami Page 1 of 3 Printed On: 6/19/2007 File Number:: 07-00873 "CHAPTER 50 SHIPS, VESSELS, AND WATERWAYS ARTICLE V. CITY MARINAS DIVISION 4. RATES, CHARGES, BILLING; AND COLLECTION Sec. 50-344. Capital improvement Fund. Recognizing that our city marinas serve as stewards of the environment and as family -friendly gateways to water based recreational and commercial activities, it is vital to the best interests of the city to provide a dedicated and sustainable source of funding for vital capital repair and improvement proiects, and as a source of match funding for capital grant opportunities. Toward that end, ten percent (10%) of the Gross dockage monies received each fiscal year shall be set aside into a special account that shall be dedicated to funding necessary capital repairs and capital related improvements to city marinas and mooring facilities and for the provision of matching funds for grant opportunities. Section 3. All ordinances or parts of ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty {30) days after final reading and adoption thereof.{2} APPROVIFD AS TO FORM AND CORRECTNESS: JQ GE L. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
